Indonesia) | Peran tes DNA dan Visum et Repertum kerangka tulang korban dalam proses pembuktian perkara tindak pidana pembunuhan berencana Nomor 7/Pid.B/2020/PN Bms, peran DNA untuk mengungkap genetik atau identitas para korban dan peran Visum et Repertum untuk mengungkap bagaimana penyebab kematian para korban, kedua peran tersebut dilakukan dengan cara pemeriksaan medis. Tuntutan Jaksa Penuntut Umum dengan dakwaan kombinasi yaitu kumulatif dan subsidair. Hakim terlebih dahulu mempertimbangkan dakwaan Jaksa Penuntut Umum dalam memutus kesalah para Terdakwa. Metode penelitian yang digunakan yuridis normatif, dengan spesifikasi penelitian preskriptif. Penelitian ini menggunakan data primer,sekunder, dan tersier. Berdasarkan hasil penelitian disimpulkan bahwa peran DNA untuk mengungkap genetik atau identitas para korban dan peran Visum et Repertum untuk mengungkap bagaimana penyebab kematian para korban. Secara yuridis Terdakwa 1 Irvan Firmansyah dan Terdakwa 2 Achmad Saputra terbukti melakukan perbuatan melawan hukum sebagaimana diatur dalam surat dakwaan Jaksa Penuntut Umum, non yuridis perbuatan para Terdakwa menimbulkan perasaan sedih yang sangat mendalam pada keluarga. Para Terdakwa yang menunjukkan sikap atau karakter diri para Terdakwa yang kurang dapat memberikan penghargaan terdahap kehidupan manusia. |

The prosecution of the Public Prosecutor with a combination of cumulative and subsidiary charges. The judge first considers the indictment of the Public Prosecutor in deciding the guilt of the Defendants. The research method used is normative juridical, with prescriptive research specifications. This study uses primary, secondary, and tertiary data. Based on the results of the study, it was concluded that the role of DNA was to reveal the genetics or identity of the victims and the role of Visum et Repertum to reveal the cause of death of the victims. Juridically Defendant 1 Irvan Firmansyah and Defendant 2 Achmad Saputra were proven to have committed unlawful acts as stipulated in the indictment of the Public Prosecutor, non-juridically the actions of the Defendants caused deep feelings of sadness to the family. The Defendants who show the attitude or character of the Defendants are less able to give respect to human life. |
