| Abstrak (Bhs. Indonesia) | Perceraian merupakan titik akhir dari suatu perkawinan yang tidak mampu mencapai tujuan yang mulia yakni kebahagiaan keluarga sebagaiamana yang diharapkan oleh setiap pasangan suami istri. Melakukan perceraian harus mempunyai cukup alasan untuk dapat dilangsungkan di Pengadilan, alasan itu sendiri diatur dalam penjelasan Pasal 39 ayat (2) Undang – undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Pasal 116 Kompilasi Hukum Islam. Adanya kasus Perceraian karena suami melanggar taklik talak membuat penulis tertarik untuk melakukan penelitian tentang perceraian karena suami melanggar taklik talak. Rumusan masalah dalam penelitian ini adalah bagaimana dasar pertimbangan hukum hakim dalam memutus perkara perceraian dan bagaimana akibat hukum dari perceraian karena melanggar taklik talak pada Putusan Pengadilan 0099/Pdt.G/2019/MS-STR. Metode yang digunakan adalah yuridis normatif, spesifikasi penelitian berupa perspektif analitik, metode pengumpulan data menggunakan studi kepustakaan dan inventarisasi data sekunder yaitu Putusan Pengadilan 0099/Pdt.G/2019/MS-STR, metode analisis menggunakan normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, dapat disimpulkan bahwa pada kasus perceraian karena melanggar taklik talak dengan nomor Putusan Pengadilan 0099/Pdt.G/2019/MS-STR, hakim mengabulkan perceraian antara Tergugat dengan Penggugat karena Suami telah melanggar sighat taklik talak angka (2) dan (4) yang pernah dibaca dan ditanda tangani olehnya, sesuai dengan ketentuan Pasal 116 huruf (g) Kompilasi Hukum Islam. Akibat Hukum dari kasus ini hanya terhadap anak dari Penggugat dan Tergugat, yaitu hak asuh anak jatuh kepada Penggugat dikarenakan usia anak tersebut dibawah 12 Tahun, dan Tergugat berkejawiban membiayai biaya pengasuhan tersebut |
| Abtrak (Bhs. Inggris) | Divorce is the end point of a marriage that is unable to achieve the noble goal of family happiness as expected by every married couple. Divorce must have sufficient reasons to be able to carry out a divorce in court, the reason itself is regulated in Article 39 paragraph (2) of Law Number 1 of 1974 concerning Marriage and Article 116 of the Compilation of Islamic Law. The existence of a divorce case because violatation of taklik talak intrigued the author to conduct research on divorce because the husband violated the taklik talak. The formulation of the problem in this study is how the judge's legal considerations in deciding divorce cases and what are the legal consequences of divorce due to violation of taklik talak in Court Decision 0099/Pdt.G/2019/MS-STR. The method used is normative juridical, the research specification is in the form of an analytical perspective, the data collection method uses a literature study and secondary data inventory, the analytical method uses a qualitative normative. Based on the results of the research and discussion, it can be concluded that divorce is due to violation of taklik talak in Court Decision 0099/Pdt.G/2019/MS-STR. The judge granted the divorce between the Defendant and the Plaintiff because the husband had violated the sighat taklik talak that he had read and signed, namely points (2) and (4), which is still in accordance with the provisions of Article 116 letter (g) of the Compilation of Islamic Law. The judge in his consideration granted the lawsuit because it was proven that it was true that the Defendant had said sighat taklik talak after the marriage contract and there was evidence for sighat taklik talak on the sibir of the marriage certificate. As for the legal consequences of the divorce is limited to the Plaintiff and the Defendan’s childt, which is the child is being cared for by the wife because the child is under 12 years old and the husband is obliged to pay for the care costs. |
