| Abstrak (Bhs. Indonesia) | ABSTRAK Pandemi Covid-19 saat ini banyak memberi dampak bagi masyarakat. Pemerintah telah mengeluarkan peraturan terkait pandemi ini yaitu Undang-Undang Nomor 6 Tahun 2018 tentang kekarantinaan kesehatan sebagai upaya mengurangi angka penyebaran Covid-19 yang tinggi, namun masih banyak terjadi pelanggaran. Pelanggaran kekarantinaan kesehatan banyak dilakukan oleh tokoh berpengaruh. Penulisan ini membahas tentang pertimbangan hakim pengadilan tinggi yang menerima dan menguatkan putusan Pengadilan Negeri Jakarta Timur terhadap kasus tindak pidana pelanggaran kekarantinaan Kesehatan. Penelitian ini merupakan penelitian yuridis normatif dengan metode pendekatan perundang-undangan dan metode pendekatan kasus. Data yang digunakan adalah data sekunder. Data tersebut direduksi sehingga diperoleh data khusus untuk dikaji dan diambil kesimpulan kemudian disajikan dengan teks naratif dan dianalisa menggunakan metode normatif bersifat kualitatif. Hasil penelitian berdasarkan Putusan Pengadilan Tinggi DKI Jakarta Nomor 171/Pid.Sus/2021/PT DKI, Majelis Hakim Pengadilan Tinggi menerima upaya hukum banding karena telah memenuhi syarat pengajuan banding. Pertimbangan Majelis Hakim Pengadilan Tinggi DKI Jakarta dalam menguatkan putusan Pengadilan Negeri Jakarta Timur yakni sependapat dan setuju dengan seluruh pertimbangan hukum Majelis Hakim tingkat pertama sehingga tidak terdapat alasan untuk membatalkan atau mengubah atau memperbaiki amar putusan tingkat pertama. Majelis Hakim tingkat banding seharusnya dapat memberi pertimbangan yang lebih meyakinkan lagi, bukan hanya menerima dan sependapat dengan pengadilan tingkat pertama. |

Inggris) | CONSIDERATION OF THE APPEAL JUDGE IN ACCEPTING AND STRENGTHENING THE DECISION OF THE EAST JAKARTA DISTRICT COURT ON CASES OF VIOLATIONS OF HEALTH QUARANTINE BY INFLUENTIAL FIGURES (Juridical Review of PT Jakarta Decision Number 171/Pid.Sus/2021/PT DKI) By: Rizka Dwi Ayu Anggun Novalin E1A018160 ABSTRACT The current Covid-19 pandemic has had a lot of impact on the community. The government has issued regulations related to this pandemic, namely Law No. 6 of 2018 concerning health quarantine as an effort to reduce the high number of Covid-19 spread, but there are still many violations. Violations of health quarantine are mostly committed by influential figures. This paper discusses the consideration of high court judges who accept and strengthen the decision of the East Jakarta District Court on cases of violations of Health quarantine. This research is normative juridical research with the method of statutory approach and the method of case approach. The data used is secondary data. The data is reduced so that special data is obtained for study and conclusions are then presented with narrative text and analyzed using normative methods of qualitative nature. The results of the study based on the Decision of the Dki Jakarta High Court Number 171 / Pid.Sus / 2021 / PT DKI, the High Court Judges Accepted the appeal law because it had met the requirements for the appeal. The consideration of the Jakarta High Court Judges in strengthening the decision of the East Jakarta District Court is to agree and agree with all legal considerations of the first-level Panel of Judges so that there is no reason to cancel or change or correct the first-level decision. The Appellate-level Judges should be able to give even more convincing consideration, not just accept and agree with the first-level court.
