| Abstrak (Bhs. Indonesia) | Setiap manusia memiliki hak untuk memiliki kehidupan yang lebih baik sebagai bentuk dari terpenuhinya hak ekonomi. Salah satu hak ekonomi adalah hak untuk bekerja termasuk bagi mereka yang mencari kerja di negara lain. Kasus migrasi warga Meksiko ke Amerika Serikat mulai 1980 sampai dengan 2019 cenderung meningkat, sehingga Amerika Serikat mengeluarkan family separation policy terhadap imigran pencari kerja dari Meksiko pada 2018. Hal ini bertentangan dengan Universal Declaration of Human Rights pasal 23 yang mengatur tentang hak setiap orang untuk bebas mendapatkan pekerjaan tanpa diskriminasi. Tujuan dari penelitian ini adalah mengkaji tentang pengaturan hak ekonomi pada keluarga dalam hukum internasional dan family separation policy terhadap imigran Meksiko di Amerika Serikat ditinjau dari aspek perlindungan anak dalam hukum internasional. Metode penelitian pendekatan yang digunakan adalah analisis normatif menggunakan metode pengumpulan data yaitu studi kepustakaan, kemudian data yang diperoleh dianalisis dengan analisis normatif dan disajikan secara deskriptif Hasil penelitian menunjukkan bahwa pengaturan hak ekonomi migran diatur dalam UDHR 1948 Pasal 23 , ICCPR 1966 salah satunya Pasal 1, ICESCR 1966 Pasal 11 poin 1, Migration for Employment 1949 dan Protection of Migrant Workers for Underdeveloped Countries 1955 oleh ILO. Pelaksanaan family separation policy imigran Meksiko tidak sesuai dengan CRC 1989 terutama dalam empat prinsip utama dari konvensi tersebut dan The Mandela Rules mengenai administrasi orang-orang yang ditahan. |
| Abtrak (Bhs. Inggris) | Every human has the right to get a better life as a form of their economic rights being fulfilled. One of the form of economic right is to work in another country. The Mexicans migration to the United States (US) starting from 1980 until 2019 increased. To solve this, The US Government put out a policy named family separation policy for immigrants from Mexico in 2018. This policy violated article 23 of the Universal Declaration of Human Rights which regulates about everyone;s right to have occupations without discrimination. The purpose of this research is to study international regulations on economic rights for family and family separation policy for immigrants from Mexico to The US reviewed from children rights in international law. This research’s method is using the literature study and the data is analysed using normative analysis method. The result shows that international regulations can be seen in UDHR in which mentioned eighteen forms of human rights and one of them is the economic rights such as the right to look for jobs and the right to get salary, ICCPR in article 1, ICESCR in article 11 paragraph 1, Migration for Employment 1949 and the Protection of Migrant Workers (Underdeveloped Countries) 1955 that was put out by ILO and The United Nations. The result on the execution of family separation had violated in CRC and the Mandela Rules. |
