Indonesia) | KASUS DESAIN KAUS BERGAMBAR MURAL “JOKOWI : 404 NOT FOUND” DALAM PERSPEKTIF HUKUM PIDANA Oleh : Ihsanuddin Nursyie E1A018039 ABSTRAK Pada situasi pandemi Covid-19 muncul mural yang bergambarkan wajah Presiden Indonesia Joko Widodo dengan mata tertutup tulisan “Jokowi: 404 Not Found”. Riswan (30) melalui akun miliknya yakni @omBrewoks3 merupakan seorang penjual baju, menjadikan mural “Jokowi: 404 Not Found” tersebut sebagai desain baju yang kemudian ditawarkan lewat akun jejaring sosial Twiter, lalu pelaku diamankan oleh satuan Polres Tuban kemudian diselesaikan melalui keadilan restoratif. Penelitian ini bertujuan untuk mengetahui kasus desain kaus bergambar mural “Jokowi: 404 Not Found” dalam perspektif hukum pidana serta untuk mengetahui bagaimana penyelesaian pada pelaku kasus desain kaus bergambar mural “Jokowi: 404 Not Found” di Polres Tuban. Penelitian ini menggunakan metode penelitian hukum empiris dengan menggunakan metode pendekatan yuridis sosiologis, yaitu metode penelitian hukum yang menggunakan fakta-fakta empiris yang diperoleh dari perilaku manusia serta untuk mengamati hasil dari perilaku manusia yang berupa peninggalan fisik maupun arsip. Metode pengumpulan data dilakukan berdasar pada data primer dan data sekunder dan disajikan dalam bentuk uraian deskriptif dengan metode analisis deskriptif kualitatif. Hasil penelitian menunjukan bahwa kasus desain kaus bergambar mural “Jokowi : 404 Not Found” dalam perspektif hukum pidana termasuk dalam kualifikasi tindak pidana penghinaan dengan tulisan atau gambar yang memenuhi rumusan Pasal 310 KUHP ayat (2) dan Pasal 45 ayat (3) Undang-Undang Nomor 19 Tahun 2016. Penyelesaian kasus ini di Polres Tuban tidak dapat dikategorikan sebagai keadilan restoratif karena tidak adanya keterlibatan korban dalam mekanisme penerapan keadilan restoratif tidak memenuhi syarat, nilai dan karakteristik dari keadilan restoratif. |

Inggris) | CASE DESIGN T-shirt with MURAL IMAGE "JOKOWI : 404 NOT FOUND" IN CRIMINAL LAW PERSPECTIVE By : Ihsanuddin Nursyie E1A018039 ABSTRACT During the Covid-19 pandemic situation, a mural appeared with the face of Indonesian President Joko Widodo with his eyes closed with the words "Jokowi: 404 Not Found". Riswan (30) through his account @omBrewoks3 is a clothes seller, making the mural "Jokowi: 404 Not Found" as a shirt design which is then offered through the Twitter social networking account , then the perpetrators are secured by the Tuban Police Unit and then resolved through restorative justice. This study aims to find out the case of the T-shirt design with the mural “Jokowi: 404 Not Found” in the perspective of criminal law and to find out how to solve the case of the T-shirt design with the mural “Jokowi: 404 Not Found” at the Tuban Police. This study uses an empirical legal method with sociological juricidial approach, namely a legal research method that uses empirical facts obtained from human behavior and to observe the results of human behavior in the form of physical and archive relics. The data collection method was carried out based on primary data and secondary data and presented in the form of a descriptive description with a qualitative descripctive analysis method. The results showed that the case of a T-shirt design with a mural picture of "Jokowi: 404 Not Found" in the perspective of criminal law is included in the qualification of a criminal act of humiliation with writing or images that meet the formulation of Article 310 of the Criminal Code paragraph (2) and Article 45A paragraph (3) of Law Number 19 of 2016. The settlement of this case at the Tuban Police cannot be categorized as restorative justice because the victim's lack of involvement in the mechanism for applying restorative justice does not meet the requirements, values and characteristics of restorative justice. |
