| Abstrak (Bhs. Indonesia) | Permasalahan terkait label khususnya label pangan masih kurang mendapatkan perhatian dari pelaku usaha maupun konsumen. Pemberian informasi yang jelas, lengkap, dan jujur pada sebuah produk harus tercantum dalam label. Hal ini penting diperhatikan agar tidak merugikan konsumen yang tentunya akan berakibat hukum bagi pelaku usaha untuk bertanggung jawab terhadap konsumen. Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap konsumen atas pelaku usaha yang menjual daging babi dengan tidak mencantumkan label dan atau informasi yang jelas berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (Studi Putusan Nomor 470/Pid.Sus/2020/PN.Blb). Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan spesifikasi peneilitan deskriptif analitis. Sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan, data yang diperoleh disajikan dengan teks deskriptif sistematis, dan metode analisis data yang digunakan adalah metode normatif kualitatif. Berdasarkan hasil penelitian, dapat disimpulkan bahwa konsumen sudah mendapatkan perlindungan hukum sebagaimana telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam Putusan Nomor 470/Pid.Sus/2020/PN.Blb, hakim dalam putusannya telah menerapkan Pasal 8 ayat (1) huruf a Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen untuk menjerat Muhamad Paino Bin Marso Alm dan Tuyadi Bin Marso Alm, tetapi hakim dalam menerapkan hukumnya kurang lengkap karena hanya menerapkan Pasal 8 ayat (1) huruf a Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, hakim tidak menerapkan Pasal 8 ayat (1) huruf i Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen untuk menjerat Muhamad Paino Bin Marso Alm dan Tuyadi Bin Marso Alm. |
| Abtrak (Bhs. Inggris) | Problems related to labels, especially food labels, still receive less attention from business actors and consumers. Providing clear, complete, and honest information on a product must be listed on the label. This is important to note so as not to harm consumers, which of course will result in legal consequences for business actors to be responsible for consumers. This study aims to determine the legal protection for consumers for business actors who sell pork by not including clear labels and or information based on Law Number 8 of 1999 concerning Consumer Protection (Study of Decision Number 470/Pid.Sus/2020/PN. Blb). The method used in this research is normative juridical with descriptive analytical research specifications. The data sources used are primary legal materials, secondary legal materials, and tertiary legal materials. The data collection method was carried out by literature study, the data obtained were presented with systematic descriptive text, and the data analysis method used was a qualitative normative method. Based on the results of the study, it can be concluded that consumers have received legal protection as regulated in Law Number 8 of 1999 concerning Consumer Protection. In Decision Number 470/Pid.Sus/2020/PN.Blb, the judge in his decision has applied Article 8 paragraph (1) letter a of Law Number 8 of 1999 concerning Consumer Protection to ensnare Muhamad Paino Bin Marso Alm and Tuyadi Bin Marso Alm , but the judge in applying the law is incomplete because it only applies Article 8 paragraph (1) letter a of Law Number 8 of 1999 concerning Consumer Protection, the judge does not apply Article 8 paragraph (1) letter I of Law Number 8 of 1999 concerning Protection Consumers to ensnare the late Muhamad Paino Bin Marso and Tuyadi Bin Marso. |
