| Abstrak (Bhs. Indonesia) | Tindak pidana Korupsi merupakan tindak pidana yang dapat dilakukan secara terorganisasi. Penyelesaian tindak pidana terorganisasi ini cenderung sulit. Hal yang mendasari sulitnya penyelesaian tindak pidana tersebut dikarenakan tindak pidana terorganisasi dilakukan oleh banyak orang. Salah satu upaya untuk menyelesaikan tindak pidana terorganisasi adalah dengan dihadirkannya seorang Justice Collaborator. Pelaku tindak pidana tidak semuanya dikategorikan sebagai Justice Collaborator, ada identifikasi seseorang dapat dikatakan sebagai Justice Collaborator. Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.Jkt.Pst memuat mengenai pertimbangan hakim mengenai penolakan pemberian status Justice Collaborator. Penelitian ini merupakan penelitian kualitatif dengan metode pendekatan perundang-undangan dan metode pendekatan kasus. Data yang digunakan adalah data sekunder. Data tersebut kemudian diolah dengan reduksi data, display data serta kategorisasi data, lalu kemudian disajikan dengan teks naratif dan dianalisa dengan menggunakan metode yuridis normatif bersifat kualitatif. Penelitian ini dilakukan berdasarkan Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.Jkt.Pst yang memperoleh data sebagai berikut: majelis hakim sudah tepat dalam memutuskan penolakan permohonan status Justice Collaborator yang diajukan oleh Terdakwa Joko Soegiarto Tjandra. Alasan penolakan permohonan tersebut adalah Terdakwa Joko Soegiarto Tjandra tidak memenuhi syarat sebagaimana seseorang dapat diidentifikasikan menjadi Justice Collaborator. Syarat seseorang dapat dikatakan sebagai Justice Collaborator belum ada peraturan perundang-undangan yang pasti mengenai Justice Collaborator maka, syarat mengenai identifikasi seseorang dapat dikatakan sebagai Justice Collaborator terdapat di dalam SEMA Nomor 04 Tahun 2011. |
| Abtrak (Bhs. Inggris) | Corruption is a crime that can be carried out in an organized manner. The resolution of organized crime tends to be difficult. The thing that underlies the difficulty of solving these crimes is because organized crimes are committed by many people. One of the efforts to resolve organized crime is the presence of a Justice Collaborator. One of the efforts to resolve organized crime is the presence of a Justice Collaborator. Not all of the perpetrators of criminal acts are categorized as Justice Collaborator, there is an identification that someone can be said to be Justice Collaborator. This research is a qualitative research with a statute approac and case approach. The data used is secondary data. The data is the processed by data reduction, data display and data categorization, the the data is presented with narrative text and analyzed using a qualitative normative juridical method. The research was conducted based on Decision Number 50/Pid.Sus-Tpk/2020/PN.Jkt.Pst which obtained the following data: the panel of judges was right in deciding the rejection of the application for Justice Collaborator status submitted by the Defendant Joko Soegiarto Tjandra. The reason for the rejection of the application was that the Defendant Joko Soegiarto Tjandra did not meet the requirements as someone could be identified as a Justice Collaborator. The requirement for someone be said to be Justice Collaborator, the is no statutory regulation that definitely regulates the Justice Collaborator, so the requirements regarding the identification of a person can be said to be a Justice Collaborator contained in SEMA Nomor 04 of 2011. |
