| Abstrak (Bhs. Indonesia) | Teknologi mengalami perkembangan pesat sehingga modus operandi tindak pidana turut berkembang. Salah satu jenis kejahatan yang menggunakan modus operandi dengan teknologi adalah tindak pidana korupsi. Tindak pidana korupsi yang menjadi sorotan publik yaitu korupsi yang dilakukan oleh terdakwa pada Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.Jkt.Pst. Oleh karena adanya barang bukti digital forensik, maka penuntut umum menghadirkan tiga ahli digital forensik untuk menganalisis barang bukti dan memberikan keterangan. Penelitian ini bertujuan untuk menganalisis penerapan pembuktian keterangan ahli digital forensik dan menganalisis pertimbangan hukum hakim pada Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.Jkt.Pst. Metode penelitian yang digunakan yaitu doktrinal, sedangkan pendekatan yang digunakan adalah pendekatan undang-undang, pendekatan kasus, dan pendekatan konseptual dengan menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa penerapan pembuktian keterangan ahli pada Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.JKT.Pst menunjukkan bahwa tiga ahli telah memenuhi syarat formill berdasarkan Pasal 179 ayat (2) KUHAP, namun dua ahli lainnya belum memenuhi syarat formiil berdasarkan Pasal 168 KUHAP, satu ahli lainnya telah memenuhi syarat formiil berdasarkan Pasal 168 KUHAP serta tiga ahli sudah memenuhi syarat materiil keterangan ahli. Keterangan ahli tidak digunakan dalam pertimbangan hukum karena pada prinsipnya keterangan ahli memiliki kekuatan pembuktian bebas dan tidak menentukan. Pertimbangan hukum hakim pada Putusan Nomor 50/Pid.Sus-Tpk/2020/PN.JKT.Pst. sudah tepat dan memenuhi rasa keadilan. Adapun saran yaitu status hubungan ahli yang dihadirkan dengan terdakwa dicantumkan secara jelas dan pertimbangan hakim pada putusan ini diharapkan dapat menjadi rujukan para hakim dalam memutus perkara yang sejenis.

One type of crime that uses modus operandi with technology is the crime of corruption. The crime of corruption in the public spotlight is corruption committed by the accused in Verdict No. 50 / Pid.Sus-Tpk / 2020 / PN.Jkt.Pst. Because of the existence of forensic digital evidence, the public prosecutor presented three digital forensic experts to analyze the evidence and provide evidence. This research aims to analyze the application of evidence of forensic digital experts and analyze the legal considerations of judges in Decision No. 50 / Pid.Sus-Tpk / 2020 / PN.Jkt.Pst. The research method used is doctrinal, while the approach used is a legal approach, case approach, and conceptual approach using secondary data consisting of primary, secondary, and tertiary legal materials. The results showed that the application of expert evidence in Decree No. 50 / Pid.Sus-Tpk / 2020 / PN.JKT.Pst showed that three experts had qualified formill based on Article 179 paragraph (2) of the KUHAP, but two other experts had not qualified formiil under Article 168 kuhap, one other expert had qualified formiil based on Article 168 KUHAP and three experts had qualified material expert information. Expert information is not used in legal considerations because in principle expert information has the power of free proof and does not determine. The judge's legal consideration of Decision No. 50/Pid.Sus-Tpk/2020/PN.JKT.Pst. is appropriate and satisfies the sense of justice. The suggestion is the status of expert relationship presented with the defendant is clearly stated and the judge's consideration of this ruling is expected to be a reference for judges in deciding similar cases.
