Indonesia) | Ketentuan Pasal 1 butir (1) Kitab Undang-undang Hukum Acara Pidana (KUHAP) menyatakan Penyidik adalah Pejabat Polisi Negara Republik Indonesia atau pejabat pegawai negeri sipil tertentu yang diberi wewenang khusus oleh undang-undang untuk melakukan penyidikan. Pasal 1 Butir 5 KUHAP mencantumkan penyelidikan adalah serangkaian tindakan untuk mencari dan menemukan suatu peristiwa yang diduga kuat sebagai tindak pidana guna menentukan dapat atau tidaknya dilakukan penyidikan menurut carayang diatur dalam undang-undang. Penelitian ini bertujuan mengetahuipengungkapan kasus menyebarkan berita bohong terkait hasil tes swab Habib Rizieq Shihab (HRS) oleh Dirut RS Ummi Bogor dalam tahap penyidikan di Bareskrim Polri dan kendala penyidik Bareskrim Polri dalam mengungkap kasus menyebarkan berita bohong terkait hasil tes swab Habib Rizieq Shihab (HRS) oleh Dirut RS Ummi Bogor. Metode penelitian yang digunakan adalah yuridis sosiologis dengan spesifikasi penelitian deskriptif. Data yang digunakan dalam penelitian ini adalah data primer dan sekunder. Data primer diperoleh melalui wawancara dengan informan, sedangkan data sekunder diperoleh dari studi kepustakaan. Data yang telah diperoleh kemudian diolah dan dianalisis dengan metode kualitatif dan disajikan dalam bentuk uraian yang tersistematis. Hasil penelitian menunjukkan bahwa pengungkapan menyebarkan berita bohong terkait hasil tes swab Habib Rizieq Shihab (HRS) oleh Dirut RS Ummi Bogor, yaituadanya laporan atau informasi dari masyarakat bahwa adanya dugaan penyebaran berita bohong hasil tes swab Habib Rizieq Shihab (HRS) oleh Dirut RS Ummi Bogor.Penyidik Bareskrim Polri segera mengumpulkan bahan-bahan keterangan dengan cara melakukan klarifikasi terhadap pihak-pihak terkait dan memperoleh bukti-bukti yang berhubungan dengan tindak pidana tersebut yaitu Video itu yang diunggah ke kanal YouTube milik RS Ummi. Dalam video tersebut, Rizieq mengaku hasil pemeriksaannya baik dan akan pulang dari RS Ummi atas permintaannya sendiri karena merasa sudah segar sebagai alat bukti petunjuk. Dalam penegakan hukum terkait kasus tersebut,penyidik terkendala oleh faktor hukumnya, faktor masyarakat dan faktor budaya. |

Inggris) | The provisions of Article 1 point (1) of the Criminal Procedure Code (KUHAP) states that investigators are Indonesian National Police Officers or certain civil servants who are given special authority by law to conduct investigations. Article 1 Point 5 of the Criminal Procedure Code states that an investigation is a series of actions to seek and find an event that is strongly suspected of being a criminal act in order to determine whether or not an investigation can be carried out according to the method regulated by law. This study aims to determine the disclosure of cases of spreading false news related to the results of the Habib Rizieq Shihab (HRS) swab test by the President Director of the Ummi Hospital, Bogor in the investigation stage at the National Police Criminal Investigation Department and the obstacles faced by the Indonesian Police Criminal Investigation Unit investigators in uncovering cases of spreading false news related to the results of the Habib Rizieq Shihab (HRS) swab test. by the President Director of the Bogor Ummi Hospital. The research method used is sociological juridical with descriptive research specifications. The data used in this study are primary and secondary data. Primary data was obtained through interviews with informants, while secondary data was obtained from literature study. The data that has been obtained is then processed and analyzed by qualitative methods and presented in the form of a systematic description.The results showed that the disclosure of spreading false news related to the results of the Habib Rizieq Shihab (HRS) swab test by the President Director of the Ummi Hospital in Bogor, namely the existence of reports or information from the public that there was an alleged spread of fake news from the results of the Habib Rizieq Shihab (HRS) swab test by the President Director of the Bogor Ummi Hospital. The Criminal Investigation Police investigators immediately collected information by clarifying the relevant parties and obtaining evidence related to the crime, namely the video which was uploaded to the Ummi Hospital's YouTube channel. In the video, Rizieq admits that his examination results are good and will return from Ummi Hospital at his own request because he feels it is fresh as evidence for instructions. In law enforcement related to the case, investigators are constrained by legal factors, community factors and cultural factors. |
