Indonesia) | PENERAPAN PASAL 7 AYAT 2 UU No. 16 TAHUN 2019 DALAM PERMOHONAN DISPENSASI PERKAWINAN (Tinjauan Yuridis Putusan Pengadilan Negeri Amurang Nomor 5/PDT.P/2020/PN Amr) Oleh : Hanah Kania Satya Irdanie E1A018189 ABSTRAK Batas umur perkawinan memiliki pembaharuan dalam pengaturannya melalui Pasal 7 Ayat (1) Undang – Undang Nomor 16 Tahun 2019, yang mana kini batas umur perkawinan secara kuantitatif lebih tinggi dibandingkan dalam pengaturan sebelumnya yaitu menjadi 19 (Sembilan belas) tahun bagi pria dan wanita. Pasal 7 Ayat (2) juga memiliki pembaharuan, yaitu bahwa dalam hal permohonan dispensasi perkawinan harus disertai dengan alasan yang mendesak dan bukti pendukung yang cukup. Rumusan masalah dalam penelitian ini adalah bagaimana dasar pertimbangan hukum hakim dalam mengabulkan permohonan dispensasi perkawinan (Tinjauan Yuridis Putusan Pengadilan Negeri Amurang Nomor 5/PDT.P/2020/PN Amr). Metode yang digunakan adalah yuridis normatif, spesifikasi penelitian yaitu metode penelitian preskriptif, metode pengumpulan data menggunakan studi kepustakaan dan pencatatan, metode analisis menggunakan normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, dapat disimpulkan bahwa Hakim dalam mengabulkan permohonan tersebut mendasarkan pada Pasal 7 Undang – Undang Nomor 16 Tahun 2019. Akan tetapi mengesampingkan ada atau tidaknya syarat khusus dispensasi perkawinan yang tertera dalam Pasal 7 Ayat (2) Undang – Undang Nomor 16 Tahun 2019 yaitu terkait alasan sangat mendesak dan bukti pendukung yang cukup, padahal dalam hal ini calon mempelai wanita tidak dalam keadaan hamil sehingga tidak dapat dikatakan dalam keadaan mendesak. Inggris) | THE IMPLEMENTATION OF ARTICLE 7 SECTION (2) STATUE NUMBER 16 YEAR 2019 IN THE PLEA FOR MARITAL DISPENTATION (Juridical Review of the Amurang Court Decision Number 5/PDT.P/2020/PN Amr) By: Hanah Kania Satya Irdanie E1A018189 ABSTRACT The age limitation for marriage has a recent adjustment on it’s new regulation which is in the article 7 section 1 of Statute Number 16 Year 2019. Now the age limitation is quantitatively increased to 19 (nineteen) years old for both men and women. Article 7 Section 2 of the same law also has a new adjustment, In the event of a plea for Marital Dispentation must be completed with a pressing reason and a supporting evident. The plea for dispentation of marriage in this paper was granted because both of the bride to be and their parent was in consent of this marriage. But there isn’t any pressing reason or a supporting evident that being put forward in the claimant’s statement. The formulation of the problem of this study is how the judge’s legal consideration in granting the plea for Marital Dispentation on the decision number 5/PDT.P/2020/PN Amr. The method used is normative juridicial, the research specification is in the form of prescriptive research method, the data collected by literation study and writing method, and the analytical method uses a qualitative normative. The judge in granted the plea for marital dispentation refers to the article 7 of Statute Number 16 Year 2019. However the judge ignore the special condition for marital dispentation that stated in the article 7 section 2 of Statute Number 16 Year 2019 which regulate that marital dispensation must be supported with pressing reason and supporting evident, whereas in this case the bride to be is not pregnant that is why it can not be inferred that they are in a pressing situation.
