| Abstrak (Bhs. Indonesia) | Masalah lalu lintas merupakan salah satu permasalahan yang sering terjadi di Negara maju maupun negara berkembang. Sejauh ini penyelesaian perkara kecelakaan lalu lintas, lebih banyak diselesaikan dengan upaya penal dibandingkan dengan upaya non-penal. Berdasarkan hal tersebut penulis ingin menganalisis dan memahami perluasan penerapan konsep restorative justice dalam penyelesaian perkara kecalakaan lalu lintas dan akaibat hukum terhadap pelaku dengan diterapkannya konsep Restorative Justice pada perkara kecelakaan lalu lintas. Penelitian ini menggunakan metode deskriptif analisis yaitu dengan pendekatan yuridis normative. Hasil dari penelitian ini menunjukan bahwa konsep penerapan restorative justice dalam penyelesaian perkara kecelakaan lalu lintas merupakan tujuan pemidanaan karena pidana penjara bukan solusi terbaik dalam menyelesaikan kasus-kasus kecelakaan lalu lintas, karena kerugian yang ditimbulkan kepada korban masih bisa di restorasi sehingga semangat untuk mengupayakan pemulihan sekaligus menjamin tercipta rasa keadilan dan kemanusiaan, mengedepankan kepentingan korban dan pelaku. Dan akibat hukum terhadap pelaku adalah berkewajiban untuk mengembalikan, mengganti atau merestorasi segala kerugian yang ditimbulkan oleh kecelakaan lalu lintas yang disebabkan oleh pelaku sehingga dapat mewujudkan keadilan bagi korban. |
| Abtrak (Bhs. Inggris) | Traffic problems are one of the problems that often occur in developed and developing countries. So far, the resolution of traffic accident cases is mostly resolved by penal efforts compared to non-penal efforts. Based on this, the author wants to analyze and understand the expansion of the application of the concept of restorative justice in solving traffic accident cases and the legal consequences for perpetrators by applying the concept of Restorative Justice in traffic accident cases. This study uses a descriptive analysis method that is a normative juridical approach. The results of this study indicate that the concept of applying restorative justice in solving traffic accident cases is the goal of punishment because imprisonment is not the best solution in resolving cases of traffic accidents, because the losses caused to victims can still be restored so that the spirit to seek recovery at once ensure the creation of a sense of justice and humanity, prioritizing the interests of victims and perpetrators. And the legal consequence of the perpetrator is the obligation to return, replace or restore all losses caused by traffic accidents caused by the perpetrators so that justice can be achieved for the victims.
