| Abstrak (Bhs. Indonesia) | Perekonomian merupakan salah satu aspek penting dalam sebuah negara, dimana dalam praktiknya akan selalu berdampingan dengan hukum. Terwujudnya suatu negara dengan perekonomian yang baik sangat bergantung pada bagaimana penerapan hukum dalam negara tersebut. Bentuk nyata hal tersebut adalah dengan adanya hukum perusahaan, dengan salah satu prinsip yang ada didalamnya yaitu Good Corporate Governance atau biasa disebut dengan GCG. Setiap perusahaan yang ada di Indonesia diwajibkan menerapkan GCG, salah satunya Badan Usaha Milik Negara (BUMN). Salah satu BUMN yang ada di Indonesia adalah PT. Permodalan Nasional Madani (Persero) Cabang Purwokerto, yang mana dalam penelitian ini akan diketahui bagaimana penerapan prinsip GCG dalam perusahaan tersebut. Metode pendekatan yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif. Data yang digunakan adalah data sekunder berupa buku-buku literatur, peraturan Perundang-undangan, dan dokumen resmi dengan cara studi pustaka, selain itu terdapat juga data primer yang diperoleh melalui wawancara dengan pihak berkompeten terkait. Semua data tersebut disajikan dalam bentuk deskriptif dengan menggunakan metode analisis normatif kualitatif. Hasil penelitian menunjukan bahwa PT. Permodalan Nasional Madani (Persero) Cabang Purwokerto telah menerapkan prinsip Good Corporate Governance (GCG), baik itu prinsip transparansi, akuntabilitas, pertanggungjawaban, kemandirian maupun kewajaran dengan sesuai aturan hukum yang berlaku. Aturan hukum yang dimaksud adalah Peraturan Menteri Negara Badan Usaha Milik Negara Nomor: PER-01/MBU/2011 tentang Penerapan Tata Kelola Perusahaan yang Baik (Good Corporate Governance) pada Badan Usaha Milik Negara. Hal ini dibuktikan dalam hasil penilaian GCG beberapa tahun terakhir, yang mana PT. Permodalan Nasional Madani mendapat predikat “baik” atau bahkan “sangat baik”. |
| Abtrak (Bhs. Inggris) | The economy is one of the important aspects of a country, where in practice it will always coexist with the law. The realization of a country with a good economy depends largely on how the application of the law in that country. The real form of this is the existence of corporate law, with one of the principles contained in it, namely Good Corporate Governance or commonly called GCG. Every company in Indonesia is required to implement GCG, one of which is State-Owned Enterprises (SOEs). One of the SOEs in Indonesia is PT. Permodalan Nasional Madani (Persero) Purwokerto Branch, which in this research will be known how the application of GCG principles in the company. The approach method used in this research is the method of normative juridical approach. The data used is secondary data in the form of literature books, laws, and official documents way of literature studies, in addition, there are also primary data obtained through interviews with relevant competent parties. All such data is presented in descriptive form using qualitative normative analysis methods. The results showed that PT. Permodalan Nasional Madani (Persero) Purwokerto Branch has applied the principles of Good Corporate Governance (GCG), be it the principles of transparency, accountability, responsibility, independency, and fairness by the applicable law. The rule of law in question is the Regulation of the Minister of State-Owned Enterprises Number: PER-01/MBU/2011 on the Implementation of Good Corporate Governance in State-Owned Enterprises. This is evidenced in the results of GCG assessments in recent years, which is PT. Permodalan Nasional Madani (Persero) gets the title "good" or even "very good". |
