Indonesia) | KETIDAKPASTIAN HUKUM PELAKSANAAN PIDANA MATI DI INDONESIA Oleh: Muhammad Isa Abdillah E1A017053 ABSTRAK Kepastian hukum menjadi salah unsur penting dalam hal berjalannya efektivitas hukum secara baik. Implementasi pelaksanaan di lapangan mengenai pidana mati di Indonesia memiliki berbagai permasalahan dari aspek peradilan, upaya hukum, maupun hingga upaya pengampunan oleh Presiden Republik Indonesia oleh terpidana mati ataupun jaksa penuntut umum. Oleh karena itu penelitian ini bertujuan untuk mengetahui pelaksanaan pidana mati di Indonesia serta faktor-faktor penyebab terjadinya ketidakpastian hukum pelaksanaan pidana mati. Penelitian ini menggunakan metode penelitian kualitatif dengan socio legal approach dan spesifikasi penelitian deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan pidana mati menggunakan Undang-Undang Republik Indonesia Nomor 2/PNPS/1964 tentang Tata Cara Pelaksanaan Pidana Mati yang Dijatuhkan oleh Pengadilan di Lingkungan Peradilan Umum dan Militer serta Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 12 Tahun 2010 tentang Tata Cara Pelaksanaan Pidana Mati. Pelaksanaan pidana mati di Indonesia tidak terlepas dengan prosedur hukum peradilan pidana, upaya hukum, hingga upaya pengampunan kepada Presiden Republik Indonesia yang pada akhirnya mengakibatkan terjadinya over population terpidana mati di dalam Lembaga Pemasyarakatan. Faktor-faktor penyebab ketidakpastian hukum pelaksanaan pidana mati terjadi akibat adanya disharmonisasi hukum dan belum diaturnya aturan pelaksana maupun mekanisme hukum dalam perundang-undangan. Selain itu sikap lembaga-lembaga dalam rumpun eksekutif, legislatif, maupun yudikatif tidak menuntaskan permasalahan yang terjadi maupun tidak menjalankan perintah undang-undang sebagaimana mestinya. Didukung adanya pro-kontra dalam lingkup masyarakat mengenai pidana mati menyebabkan terjadinya ketidakpastian hukum pelaksanaan pidana mati di Indonesia mengakibatkan death row phenomenon hingga puluhan tahun lamanya. Inggris) | LEGAL UNCERTAINTY THE EXECUTION OF THE DEATH PENALTY IN INDONESIA By: Muhammad Isa Abdillah E1A017053 ABSTRACT Legal certainty is an important element in terms of the effectiveness of the law properly. The executions in the field regarding the death penalty in Indonesia has various problems from the judicial aspect, legal remedies, as well as efforts to pardon by the President of the Republic of Indonesia by death convicts or public prosecutors. Therefore, this research aims to determine the implementation of executions death penalty in Indonesia and the factors that cause legal uncertainty in executions of death penalty. This research uses qualitative research methods with a socio legal approach and descriptive research specifications. The results of the research indicate that the implementation of the death penalty uses the Law of the Republic of Indonesia Number 2/PNPS/1964 concerning Procedures for Executions the Death Penalty Sentenced by Courts in the General and Military Courts and the Regulation of the Head of the Indonesian National Police Number 12 of 2010 concerning Procedures for Executions Death Penalty. The implementation of the death penalty in Indonesia is inseparable from criminal justice legal procedures, legal remedies, and efforts to pardon from the President of the Republic of Indonesia which ultimately results in overpopulation of death row inmates in Correctional Institutions. The factors that cause legal uncertainty in the executions of the death penalty occur due to legal disharmony and the implementation of implementing regulations and legal mechanisms in the legislation has not been regulated. In addition, the attitude of institutions in the executive, legislative, and judicial clumps does not solve the problems that occur or do not carry out the orders of the law as they should. Supported by the pros and cons in the community regarding the death penalty, causing legal uncertainty in the executions of the death penalty in Indonesia, resulting in the death row phenomenon for decades.
