Indonesia) | PERAN KEPOLISIAN DALAM MENANGGULANGI TINDAK PIDANA LALU LINTAS JALAN YANG DI LAKUKAN OLEH ANAK ( Studi Kasus di Wilayah Polres Klaten ) Oleh: Raden Joa Kansha RLS E1A016232 ABSTRAK Keterlibatan pelajar sebagai pengendara motor di bawah umur yaitu pengendara motor yang bertentangan dengan Undang-Undang Republik Indonesia nomor 22 tahun 2009 Pasal 81 ayat (2), bahwa seseorang berhak memiliki SIM C pada usia 17 Tahun. Siswa SMP merupakan remaja awal yang rentang usianya 12 sampai 15 tahun. Oleh karena itu belum berhak mengendarai kendaraan bermotor dan belum berhak memiliki Surat Izin Mengemudi (SIM) dan pada kenyataannya, banyak pelajar SMP dan SMA yang mengendarai kendaraan bermotor, hal ini jelas melanggar hukum. Pada penelitian ini akan membahas terkait peran kepolisian dalam menanggulangi tindak pidana lalu lintas dan bagaimana hambatan kepolisian dalam melakukan penegakan hukum terhadap kasus kecelakaan yang di lakukan oleh anak di Polres Klaten. Metode yang digunakan dalam penelitian ini adalah yuridis empiris, spesifikasi penelitian menggunakan deskriptif analitis, teknik pengumpulan data dilakukan dengan metode wawancara. Berdasarkan hasil penelitian ini menunjukkan bahwa peran kepolisian dalam menanggulangi tindak pidana lalu lintas jalan yang di lakukan oleh anak di Polres Klaten yaitu menggunakan upaya preventif dan represif. Upaya preventif dilakukan dengan sosialiasi terkait tertib lalu lintas di sekolah dan upaya represif yang dilakukan dengan cara penertiban, patroli dan tilang. Hambatan yang di alami Polres Klaten dalam menanggulangi tindak pidana lalu lintas di jalan yang di lakukan oleh anak adalah faktor penegak hukum, faktor sarana dan fasilitas, faktor masyarakat dan faktor budaya. Inggris) | THE ROLE OF THE POLICE IN TACKLING ROAD TRAFFIC CRIMES COMMITTED BY CHILDREN (Study Case In District Polres Klaten) By: Raden Joa Kansha RLS E1A016232 ABSTRACT The involvement of students as underage motorcycle riders, namely motorcyclists who do not conflict with the Law of the Republic of Indonesia number 22 of 2009 Article 81 paragraph (2), that a person has the right to have a SIM C at the age of 17 years. Junior high school students are the beginning of the age range of 12 to 15 years. Therefore, they do not have the right to drive a motorized vehicle and do not have the right to have a driver's license (SIM) and in fact, many junior and senior high school students drive motorized vehicles, this is clearly against the law. Juridically, junior and senior high school students under the age of 17 who drive motorized vehicles have violated Law No. 22 of 2009 concerning Road Traffic and Transportation. In this study discussing problems regarding the role of the police in tackling traffic crimes and how the obstacles of the police in enforcing the law against cases of accidents committed by children at the Klaten Police. The method used in this study is empirical juridical, the research specification uses analytical descriptive, data collection techniques are carried out by the interview method. Based on the results of this study indicate that the role of the police in tackling road traffic crimes committed by children at the Klaten Police is using preventive and repressive efforts. Preventive efforts are carried out with socialization related to traffic order in schools and repressive efforts are carried out by controlling, patrolling and ticketing. The obstacles experienced by the Klaten Police in tackling traffic crimes on the road carried out by children are law enforcement factors, facilities and facilities factors, community factors and cultural factors.
