Indonesia) | TINJAUAN YURIDIS TERHADAP PENDAFTARAN MEREK BERDASARKAN UNDANG-UNDANG NOMOR 20 TAHUN 2016 TENTANG MEREK DAN INDIKASI GEOGRAFIS DALAM PUTUSAN MAHKAMAH AGUNG NOMOR : 1146/PDT.SUS-HKI/2020 Oleh : Cindy Maulidia E1A017030 ABSTRAK Pendaftaran merek merupakan proses mendaftar suatu produk agar memiliki perlindungan hukum dan terjamin untuk di perjual belikan oleh pemilik merek ataupun badan usaha. Penelitian yang dilatarbelakangi oleh permasalahan dalam Penolakan Pendaftaran Merek terkait adanya merek yang menggunakan kata umum atau generik, seperti kasus antara Acer Incorporated dengan Pemerintah Republik Indonesia cq, Kementrian Hukum dan Hak Asasi Manusia Republik Indonesia cq, Direktorat Jenderal Kekayaan Intelektual cq, Komisi Banding Merek. Penelitian ini merupakan penelitian yuridis normatif. Sumber data yang digunakan adalah data sekunder yang di peroleh dari studi kepustakaan berupa bahan hukum primer, sekunder, dan tersier. Data yang terkumpul akan dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian menunjukkan bahwa Majelis Hakim Mahkamah Agung dalam perkara a quo telah sesuai dengan ketentuan dalam Pasal 22 Undang – Undang Nomor 20 Tahun 2016 Tentang Merek dan IG. Merek milik Penggugat telah terdaftar di Taiwan di kelas 9 sejak tahun 2008. Kemudian Penggugat mendaftarakan mereknya di Indonesia dengan Nomor Agenda D00.2017.047770 di kelas 9 untuk melindungi produk-produknya, namun Direktorat Merek dan Indikasi Geografis menerbitkan surat pemberitahuan penolakan permohonan pendaftaran merek milik Penggugat karena adanya persamaan pada pokonya dengan merek yang telah terdaftar terlebih dahulu. Inggris) | JURIDICAL REVIEW OF MARK REGISTRATION BASED ON LAW NUMBER 20 YEAR 2016 CONCERNING MARKS AND GEOGRAPHIC INDICATIONS IN THE SUPREME COURT DECISION NUMBER: 1146/PDT.SUS-HKI/2020 By : Cindy Maulidia E1A017030 ABSTRACT Trademark registration is the process of registering a product so that it has legal protection and is guaranteed to be traded by the brand owner or business entity. The research is motivated by problems in the refusal of Mark Registration related to the existence of brands that use general or generic words, such as the case between Acer Incorporated and the Government of the Republic of Indonesia cq, the Ministry of Law and Human Rights of the Republic of Indonesia cq, the Directorate General of Intellectual Property cq, the Mark Appeal Commission. This research is a normative juridical research. Sources of data used are secondary data obtained from library studies in the form of primary, secondary, and tertiary legal materials. The collected data will be analyzed in a qualitative normative manner. Based on the results of the study, it shows that the Supreme Court Judges in the a quo case have complied with the provisions in Article 22 of Law Number 20 of 2016 concerning Trademarks and GI. The Plaintiff's trademark has been registered in Taiwan in class 9 since 2008. Then the Plaintiff registered his mark in Indonesia with Agenda Number D00.2017.047770 in class 9 to protect its products, however the Directorate of Marks and Geographical Indications issued a notification letter rejecting the application for registration of the Plaintiff's trademark. because of the similarity in essence with the trademark that has been registered previously.
