Indonesia) | TINJAUAN YURIDIS PERLINDUNGAN DESAIN INDUSTRI BERDASARKAN UNDANG-UNDANG NOMOR 31 TAHUN 2000 TENTANG DESAIN INDUSTRI DALAM PUTUSAN NOMOR 13/PDT.SUS-HKI/2020/PN.NIAGA.JKT.PST Oleh: YULIANI SIANTURI E1A017065 ABSTRAK Penelitian yang dilatarbelakangi oleh permasalahan dalam Hak Perlindungan Desain Industri terkait dengan adanya bentuk dan konfigurasi desain industri tiruan yang dilakukan oleh pelaku usaha lain, seperti kasus antara Thum dengan PT. Mega Karya Mandiri dan Lazada Indonesia dalam Putusan Nomor 13/Pdt.Sus-HKI/2020/PN.Niaga Jkt.Pst. Tujuan penelitian ini adalah untuk mengkaji dan menganalisis mengenai perlindungan desain industri yang melindungi sebuah desain industri kaca masker dan pembuktian bahwa desain industri tersebut telah melanggar Pasal 9 Ayat (1) dan Pasal 46 Ayat (1) Undang-Undang Nomor 31 Tahun 2000 Tentang Desain Industri. Penelitian ini merupakan penelitian yuridis normatif. Sumber data yang digunakan adalah data sekunder yang diperoleh dari studi kepustakaan berupa bahan hukum primer, sekunder, dan tersier. Data yang terkumpul akan dianalisis secara normatif kualititatif. Berdasarkan hasil penelitian menunjukan bahwa Majelis Hakim Pengadilan Niaga dalam perkara Penggugat mendapatkan perlindungan desain industri karena Penggugat adalah pemilik hak desain industri berdasar pada Sertifikat Desain Industri untuk Kaca Masker dengan Nomor Pendaftaran IDD 000046790 sehingga Penggugat dapat melaksanakan hak eksklusifnya atas bentuk dan konfigurasi kaca masker. Majelis hakim hanya mengabulkan gugatan Penggugat sebagian karena lemahnya Penggugat dalam membuktikan bahwa Tergugat I meniru bentuk dan konfigurasi kaca masker milik Penggugat dan telah memperdagangkan desain industri kaca masker tiruan tersebut di website milik Tergugat II. Inggris) | JURIDIC REVIEW OF INDUSTRIAL DESIGN PROTECTION BASED ON LAW NUMBER 31 YEAR 2000 CONCERNING INDUSTRIAL DESIGN IN COURT JUDGMENT13/PDT.SUS-HKI/2020/PN.NIAGA.JKT.PST By: YULIANI SIANTURI E1A017065 ABSTRACT Research based on problems in Rights Industrial Design is related to the form of protection and design configuration fake industry committed by other business actors, such as the case between Thum with PT. Mega Karya Mandiri and Lazada Indonesia in Court Judgment Number 13/Pdt.Sus HKI/2020/PN.Niaga Jkt.Pst. The purpose of this research is to examine and analyze the protection of industrial designs that protect an industrial google mask design and prove that the design the industry has violated Article 9 Paragraph (1) and Article 46 Paragraph (1) of the Law Number 31 of 2000 concerning Industrial Design. This research is a normative juridical research. Sources of data that used is secondary data obtained from literature study in the form of primary, secondary, and tertiary legal materials. The data collected will be analyzed qualitatively normative. Results Based on the research shows that the Panel of Judges The Commercial Court in the plaintiff's case gets design protection industry because the Plaintiff is the owner of the industrial design rights based on Industrial Design Certificate for Glass Masks with IDD Registration Number000046790 so that the Plaintiff can exercise its exclusive right to the form and glass masks. The panel of judges only granted the request The Plaintiff is partly due to the Plaintiff's weakness in proving that Defendant I lawsuits the shape and configuration of the Plaintiff's glass mask and has traded the industrial design of the mock-up mask on the property's website Defendant II.
