| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana pertimbangan hukum hakim yang mengabulkan eksepsi Obscuur Libel pada Putusan Nomor 13/Pdt.G/2018/PN.Pbg serta mengetahui dan menganalisis bagaimana akibat hukum dengan dikabulkannya eksepsi Obscuur Libel. Penggugat dalam perkara ini berjumlah 2 (dua) orang, dan Tergugatnya berjumlah 1 (satu) orang, serta Turut Tergugatnya berjumlah 2 (dua) orang. Dengan objek sengketa jual beli sebidang tanah yang terletak di Rt 001 Rw 003 Desa Makam, Kec. Rembang, Kabupaten Purbalingga, luas 267 m², yang tertuang dalam Sertifikat Hak Milik (dahulu) SHM Nomor 03538 atas nama Sugeng bin Nurngali, yang sekarang telah menjadi SHM Nomor 04056 atas nama Yuniati Cs. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Peneliti menggunakan bahan hukum primer dan bahan hukum sekunder dengan inventarisasi hukum normatif, data dianalisis secara normatif kualitatif. Hasil dari penelitian ini, para Penggugat tidak menjelaskan kedudukan Turut Tergugat I dan Turut Tergugat II dalam fundamentum petendi, sehingga Tergugat mengajukan eksepsi obscuur libel. Majelis Hakim atas eksepsi tersebut memberikan keputusan dengan menerima eksepsi Tergugat dan menyatakan gugatan para Penggugat tidak diterima/NO (Niet Ontvankelijk Verklaad). |

Inggris) | ABSTRACT This study aims to determine and analyze how the legal considerations of judges who grant Obscuur Libel exception on Decision Number 13 / Pdt.G / 2018 / PN.Pbg and to find out and analyze how the legal consequences are granted by the exception of Obscuur Libel. There are 2 (two) Plaintiffs in this case, and 1 (one) Defendant, and 2 (two) Co-Defendants. With the object of the sale and purchase dispute over a plot of land located at Rt 001 Rw 003 Desa Makam, Kec. Rembang, Purbalingga Regency, with an area of 267 m², which is stated in the Certificate of Ownership (formerly) SHM Number 03538 in the name of Sugeng bin Nurngali, which has now become SHM Number 04056 in the name of Yuniati Cs. The method research used in this study is normative juridict. Researchers used primary legal materials and secondary legal materials with a normative legal inventory, data were analyzed normatively qualitatively. The results of this study, the Plaintiffs did not explain the position of Co-Defendant I and Co-Defendant II in the petendi fundamentum, so the Defendant filed an exception obscuur libel. The Panel of Judges on the exception gave a decision by accepting the Defendant's exception and stating that the Plaintiff's claim was not accepted / NO (Niet Ontvankelijk Verklaad). |
