Indonesia) | PENGGUNAAN SISTEM TRAFFIC ACCIDENT ANALYSIS PADA TAHAP PENYIDIKAN TINDAK PIDANA LALU LINTAS (Studi Kasus di Satlantas Polresta Banyumas) Oleh : Herman Rohmat E1A116058 ABSTRAK Perkembangan teknologi saat ini menjadikan proses pembuktian secara non-konvensional sudah harus menjadi perhatian khususnya dalam perkara lalu lintas, seperti sistem traffic accident analysis pada tahap penyidikan terhadap kasus kecelakaan lalu lintas. Tujuan dari penelitian ini mengetahui penggunaan sistem traffic accident analysis pada tahap penyidikan dan mengetahui kendala yang ditemui penyidik dalam melakukan penyidikan terhadap kasus lalu lintas di wilayah hukum Satlantas Polresta Banyumas. Jenis penelitian yang digunakan yuridis sosiologis. Penulis menggunakan pendekatan undang-undang, pendekatan kasus dan pendekatan konseptual. Sumber data yang digunakan data primer dan data sekunder. Teknik pengumpulan data menggunakan wawancara dan studi kepustakaan. Analisis bahan hukum secara normatif kualitatif. Hasil penelitian ini menunjukkan bahwa penggunaan sistem traffic accident analysis pada tahap penyidikan telah digunakan di Satlantas Polresta Banyumas sesuai dengan prosedur dalam Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 6 Tahun 2019 Tentang Penyidikan Tindak Pidana. Penyidik hanya melakukan penyidikan pada tahap fotogrametri saja, terdapat beberapa kegiatan yang tidak dilakukan seperti pembuktian pada tahap PC Recht dan PC Crash. Penyidik juga mengalami kendala dalam melakukan penyidikan seperti kurang lengkapnya sarana atau fasilitas berupa laboratorium digital forensic dan minimnya keterangan saksi serta faktor waktu dan cuaca yang mengakibatkan kerusakan pada barang bukti yang ditemui. Inggris) | THE USE OF THE TRAFFIC ACCIDENT ANALYSIS SYSTEM IN THE STAGE OF TRAFFIC CRIMINAL INVESTIGATION (Case Study at the Banyumas Traffic Police) By: Herman Rohmat E1A116058 ABSTRACT This research originated from the number of traffic cases that occurred in Indonesia, especially in the Banyumas area. Current technological developments have made the non-conventional process of evidence a concern, especially in traffic cases such as the traffic accident analysis system during the investigation stage of traffic accidents. The purpose of this study is to determine the use of the traffic accident analysis system at the investigation stage and to find out the obstacles that investigators encounter in conducting investigations into traffic cases in the jurisdiction of the Banyumas Traffic Police. This type of research used sociological juridical. The author uses a statutory approach, a case approach and a conceptual approach. The data source used is primary data and secondary data. Data collection techniques using interviews and literature study. Analysis of legal materials in a qualitative normative manner. The results of this study indicate that the use of the traffic accident analysis system at the investigation stage has been used at the Banyumas Traffic Police in accordance with the procedures in the Regulation of the Head of the National Police of the Republic of Indonesia Number 6 of 2019 concerning Criminal Investigation. Investigators only conducted investigations at the photogrammetric stage, there were several activities that were not carried out such as verification at the PC Recht and PC Crash stages. Investigators also experience problems in carrying out investigations such as incomplete facilities or facilities in the form of a digital forensic laboratory and the lack of witness testimony as well as time and weather factors that result in damage to the evidence found.
