Indonesia) | ANALISIS TERHADAP PUTUSAN HAKIM BERUPA PEMIDANAAN TERHADAP PERKARA TANPA HAK MEMBAWA PSIKOTROPIKA (Tinjauan Yuridis Putusan Pengadilan Negeri Purwokerto Nomor: 58/Pid.Sus/2019/PN Pwt) ABSTRAK Penyalahgunaan psikotropika dapat mengakibatkan sindroma ketergantungan apabila penggunaannya tidak di bawah pengawasan. Dalam Perkara Putusan Pengadilan Negeri Purwokerto Nomor: 58/Pid.Sus/2019/PN Pwt, majelis hakim memutus terdakwa telah bersalah melakukan tindak pidana secara tanpa hak menyimpan dan membawa psikotropika. Penelitian ini bertujuan mengetahui pembuktian dan pertimbangan hukum hakim dalam tindak pidana penyalahgunaan psikotropika. Penelitian ini menggunakan tipe penelitian hukum secara yuridis normatif, dengan metode pendekatan pendekatan undang-undang (statute approach), pendekatan kasus (case approach) dan pendekatan konseptual (conseptual approach). Dalam penelitian ini sumber bahan hukum yang digunakan adalah data sekunder dan analisis data dilakukan secara deskriptif kualitatif. Berdasarkan hasil penelitian dan pembahasan maka dapat disimpulkan pembuktian sudah tepat karena ada persesuaian antara alat bukti keterangan saksi dan keterangan terdakwa. Dasar pertimbangan hukum hakim dalam menjatuhkan pidana pada Perkara Putusan Pengadilan Negeri Purwokerto Nomor: 58/Pid.Sus/2019/PN Pwt, yaitu terpenuhinya semua unsur-unsur dalam Pasal 62 Undang-Undang Nomor 5 Tahun 1997 Tentang Psikotropika, terdakwa dinilai mampu bertanggung jawab dan mampu untuk menilai bahwa perbuatan yang telah dilakukan adalah suatu perbuatan yang dilarang oleh undang-undang, adanya kesengajaan yaitu terdakwa dengan sengaja menggunakan obat Psikotropika, dan tidak adanya alasan pemaaf yaitu terdakwa mampu bertanggung jawab dan adanya kesalahaan sehingga tidak ada alasan pemaaf. Inggris) | ABSTRACT ANALYSIS OF THE JUDGMENT DECISION OF CRIMINAL UNDER THE RIGHT TO CARRY OUT PSYCHOTROPICS (Juridical Review of the Purwokerto District Court's Verdict Number: 58 / Pid.Sus / 2019 / PN Pwt) Psychotropic abuse can lead to a dependency syndrome if its use is not under supervision. In the Purwokerto District Court Decision Case Number: 58 / Pid.Sus / 2019 / PN Pwt, the panel of judges found the defendant guilty of committing a criminal act without the right to keep and carry psychotropic substances. This study aims to determine the evidence and legal considerations of judges in the crime of psychotropic abuse. This research uses a legal type of juridical normative, with a statute approach, a case approach and a conceptual approach. In this study, the source of the legal material used was secondary data and data analysis was carried out descriptively qualitatively. Based on the results of research and discussion, it can be concluded that the evidence is correct because there is an agreement between the evidence for the testimony of the witness and the testimony of the defendant. The legal basis for the judge's legal consideration in imposing a crime in the Case of the Verdict of the Purwokerto District Court Number: 58 / Pid.Sus / 2019 / PN Pwt, namely the fulfillment of all elements in Article 62 of Law Number 5 Year 1997 concerning Psychotropics, the defendant is considered capable of being responsible and is able to judge that the act that has been committed is an act prohibited by law, the existence of intent, namely the defendant deliberately using psychotropic drugs, and the absence of excuses, namely the defendant is able to take responsibility and there is an error so there is no excuse for forgiveness.
