| Judul Artikel | KEBIJAKAN PEMBEBASAN NARAPIDANA MELALUI PEMBERIAN ASIMILASI DALAM RANGKA PENCEGAHAN DAN PENYEBARAN COVID-19 (TINJAUAN YURIDIS PERATURAN KEMENTERIAN HUKUM DAN HAK ASASI MANUSIA NOMOR 10 TAHUN 2020) |
| Abstrak (Bhs. Indonesia) | Saat ini terjadi pandemi Covid-19 yang melanda beberapa negara, termasuk Indonesia. Hal tersebut yang melatarbelakangi pemerintah mengeluarkan kebijakan Peraturan Kementerian Hukum dan Hak Asasi Manusia Nomor 10 Tahun 2020 tentang Syarat Pemberian Asimilasi dan Hak Integrasi Bagi Narapidana dan Anak dalam Rangka Pencegahan dan Penanggulangan Penyeberan Covid-19. Salah satu yang berpotensi terkena Covid-19 adalah narapidana yang berada di lembaga pemasyarakatan. Penelitian ini bertujuan untuk mengetahui faktor yang melandasi dikeluarkannya Peraturan Kementerian Hukum dan Hak Asasi Manusia Nomor 10 Tahun 2020, dan kebijakan penerapan pembebasan asimilasi narapidana dalam rangka pencegahan penyebaran Covid-19. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis normatif dan spesifikasi penelitian deskriptif. Metode pengumpulan data melalui studi pustaka. Data yang diperoleh diolah dengan reduksi data, display data, dan kategorisasi data. Penyajian data dalam bentuk uraian teks naratif, dengan analisis kualitatif. Hasil penelitian menunjukan bahwa faktor yang melandasi dikeluarkannya Peraturan Kementerian Hukum dan Hak Asasi Manusia Nomor 10 Tahun 2020 secara garis besar berpijak pada 3 (tiga) faktor yaitu landasan yuridis, landasan sosiologis, dan landasan filosofis. Kebijakan penerapan pembebasan narapidana melalui pemberian asimilasi berdasarkan Peraturan Menteri Kementerian Hukum dan Hak Asasi Manusia Nomor 10 Tahun 2020 merupakan output dari kebijakan formulasi dan sekaligus kebijakan eksekutif/ pelaksanaan pidana sebagai upaya pencegahan penyebaran Covid-19 di lembaga pemasyarakatan. Namun demikian terdapat diskinkronisasi khususnya dari aspek substansial dan kultural. Kata Kunci: Kebijakan, Asimilasi, Narapidana, Covid-19. |
| Abtrak (Bhs. Inggris) | Currently, the COVID-19 pandemic has hit several countries, including Indonesia. So the government issued a policy of the Ministry of Law and Human Rights Regulation No. 10 of 2020, concerning the conditions for providing assimilation and integration rights for prisoners and children in preventing and combating the spread of COVID-19. One of those who have the potential to be affected by COVID-19 are prisoners who are in prisons. This study aims to determine the factors that underlie the issuance of regulation of the Ministry of Law and Human Rights No. 10 of 2020, and the policy of implementing the assimilation release of prisoners in order to prevent the spread of COVID-19. This research using qualitative methods with normative juridical approach and descriptive research spesifications. The data collection method using study literature which is processed by data reduction, data display, and data categorization. The result from this research will be presented by narrative text descriptive with qualitative analysis. The result shows that the factors that underlying the issuance of the Ministry of Law and Human Rights Regulations No. 10 of 2020 based from 3 (three) factors, the juridical basis, the sociological basis, and the philosopical basis. The policy of implementing the release of prisoners through assimilation based on the Minister of Law and Human Rights Regulation No. 10 of 2020 is the output of the formulation of policy and the executive or criminal impelementation policy as an effort to prevent the spread of COVID-19 in prisons. However, there is a synchronization, especially from a substantial and cultural aspect. Keywords: Policy, Assimilation, Prisoners, Covid-19. |
