| Abstrak (Bhs. Indonesia) | Penegak hukum untuk mengungkapkan tindak pidana pembunuhan terhadap anggota TNI dalam Perspektif asas aqusatoir ini adalah dengan cara upaya pengumpulan barang bukti dan alat bukti yang merupakan sarana pembuktian ini berperan dan berfungsi pada saat penyidikan mulai melakukan tindakan penyidikan dalam asas aqusatoir. Pada penelitian ini dilakukan dengan tujuan untuk mengetahui pelaksanaan tindak pidana pembunuhan terhdap anggota TNI dalam perspektif asas aqusatoir, khusus nya yang terjadi di wilayah Denpom V/3 Malang. Selain itu di tunjukan juga untuk mengetahui yang menjadi hambatan bagi penyidik tindak pidana pembunuhan terhadap anggota tni dalam perspektif asas aqusatoir. Guna mencapai tujuan tersebut maka penelitian ini dilakukan dengan menggunakan pendekatan Yuridis Sosiologis, Data Primer dan Data Sekunder yang terkumpul kemudian dioleh, dianalisis, dan disajikan menjadi satu kesatuan yang utuh. Berdasarkan dari hasil penelitian ini menyatakan bahwa dalam pelaksanaan penyidikan tindak pidana pembunuhan terhadap anggota TNI dalam Perspektif asas aqusatoir dari pelaksanaan oleh Tempat Kejadian Perkara (TKP), dimulai dari adanya laporan atau pengaduan dari seseorang yang mengetahuinya dalam bentuk lisan ataupun dalam bentuk tertulis kepada polisi yang bertindak sebagai penyidik dan diakhiri dengan penyerahan berita acara mengenai pelaksanaan penyidikan dari pejabat penyidik yaitu Ankum kepada odituran dalam militer, serta pengembalian terhadap penyidik apabila ada kekurangan, persiapan penanganan TKP, perjalanan menuju TKP, Tindakan Pertama di Tempat Kejadian Perkara (TPTKP), olah TKP yang terdiri dari pemotretan, pembuat sketsa, pengumpulan barang bukti penanganan korban, saksi, dan pelaku. Pengorganisasian olah TKP dan akhir penanganan TKP. Hambatan yang dihadapi penyidik yaitu polisi militer terbagi atas dua bagian yakni kendala dari luar penyidik berupa faktor penegak hukum, faktor waktu, faktor minimnya saran dan prasarana, dan kendala dari dalam penyidik yaitu faktor dari personil. |

This research was conducted with the aim of knowing the execution of the crime of murder against members of the TNI in the perspective of the aqusatoir principle, especially in the Denpom V / 3 area of Malang. In order to achieve this goal, this research was conducted using a sociological juridical approach. Primary and secondary data were collected and then obtained, analyzed, and presented as a whole. Based on the results of this study it is stated that in the implementation of the investigation of the crime of murder of TNI members in the perspective of the aqusatoir principle of the implementation by the crime scene (TKP), starting from a report or complaint from someone who knows about it in oral or written form to the police who acting as an investigator and ending with the submission of minutes regarding the implementation of the investigation from the investigating official, namely Ankum to the military officers, as well as returning to the investigator if there is a shortage, preparation for handling the TKP, traveling to the TKP, First Actions at the Crime Scene (TPTKP), TKP processing consisting of a photo shoot, sketch maker, collection of evidence handling victims, witnesses, and perpetrators.
