Indonesia) | ABSTRAK PUTUSAN BEBAS PELAKU TINDAK PIDANA PENYEBAR VIDEO PENGANCAMAN TERHADAP JOKOWI (Tinjauan Putusan Nomor 777/Pid.Sus/2019/Pn Jkt.Pst) Oleh : SHAFIRA GUNAWAN E1A116068 Hakim dalam membuat putusan harus memperhatikan segala aspek di dalamnya, yaitu mulai dari perlunya kehati-hatian serta dihindari sedikit mungkin ketidakcermatan, baik bersifat formal maupun materiil sampai dengan adanya kecakapan teknik dalam putusannya. Pada kasus ini, terdakwa Ina Yuniati sebagai pelaku penyebar video pengancaman terhadap Jokowi yang direkam oleh terdakwa pada saat unjuk rasa di depan Gedung Bawaslu pada bulan Mei 2019 silam, didakwa dengan dakwaan Tunggal yaitu Melanggar Pasal 27 Ayat (4) Jo. Pasal 45 Ayat (4) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Pada persidangan terakhir Hakim memvonis bebas terdakwa Ina Yuniarti, hakim menjatuhkan putusan bahwa terdakwa tidak terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana sebagaimana yang didakwakan terhadap terdakwa. Pada penelitian ini membahas permasalahan mengenai pertimbangan hukum hakim yang menjatuhkan putusan bebas terdakwa Ina Yuniarti sudah sesuai dengan surat dakwaan dan akibat hukum dengan dijatuhkannya putusan bebas bagi terdakwa dalam Putusan Nomor 777/Pid.Sus/2019/PN Jkt.Pst. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian preskriptif, sumber data yang digunakan data sekunder yang diperoleh melalui kepustakaan dan dokumenter serta diuraikan secara sistematis dengan metode analisis kualitatif. Berdasarkan hasil penelitian dan pembahasan didapati bahwa pertimbangan hukum hakim sudah sesuai dengan surat dakwaan dengan tidak terbuktinya salah satu unsur dakwaan. Dan akibat hukumnya adalah dalam hal penahanan, banding serta rehabilitasi. |

Inggris) | ABSTRACT FREE DECISION OF CRIMINAL ACTORS OF THREATING VIDEO OF THREAT TO JOKOWI (Review Of Decision Number 777 / Pid.Sus / 2019 / Pn Jkt.Pst) By: SHAFIRA GUNAWAN E1A116068 Judges in making decisions must pay attention to all aspects in it, starting from the need for caution and avoiding the slightest possible inaccuracy, both formal and material in nature to the presence of technical skills in their decisions. In this case, the defendant Ina Yuniati, as the perpetrator of the video threatening Jokowi, which was recorded by the defendant during a demonstration in front of the Bawaslu Building in May 2019, was charged with the single charge, violating Article 27 Paragraph (4) Jo. Article 45 Paragraph (4) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Electronic Information and Transactions. At the last trial the Judge acquitted the defendant Ina Yuniarti, the judge ruled that the defendant was not legally proven and convinced that he was guilty of a criminal act as was charged against the defendant. In this study, it discusses the problem of the legal considerations of the judge who gave the defendant Ina Yuniarti's acquittal in accordance with the indictment and the legal consequences of the acquittal of the defendant's decision in Decision Number 777 / Pid.Sus / 2019 / PN Jkt.Pst. This study uses a normative juridical approach withresearch specifications prescriptive, the data source used is secondary data obtained through literature and documentaries and described systematically with qualitative analysis methods. Based on the results of research and discussion, it was found that the judges' legal considerations were in accordance with the indictment with no evidence of any of the elements of the indictment. And the legal consequences are in terms of detention, appeal and rehabilitation. |
