| Abstrak (Bhs. Indonesia) | Manusia adalah makhluk yang tidak dapat hidup dengan sendiri. Manusia diciptakan sebagai makhluk sosial yang saling membutuhkan satu sama lain. Dalam kehidupannya manusia memiliki keinginan untuk bersosialisasi dengan sesamanya. Hal ini merupakan salah satu kodrat manusia yang selalu ingin berhubungan dengan manusia lain. Hubungan antar manusia tersebut biasa juga dilakukan dengan melakukan suatu perkawinan. Dalam suatu perkawinan diperlukan adanya cinta lahir batin antara pasangan suami isteri.. Pemberian nafkah merupakan kewajiban yang dimiliki oleh seorang suami yang dalam hal ini sebagai kepala keluarga dalam ajaran agama islam. Kewajiban tersebut tentunya tidak boleh dilalaikan ataupun dilupakan mengingat adanya kebutuhan yang harus terpenuhi di dalam keluarga yang di pimpin oleh seorang suami. Rumusan masalah dalam penelitian ini adalah bagaimana pertimbangan hukum hakim memutuskan perkara cerai gugat di pengadilan serui? Metodologi penelitian adalah metode pendekatan yuridis normatif, metode deskriptif analisis, sumber data sekunder, metode pengumpulan data menggunakan data kepustakaan, metode analisis data, normatif kualitatif, normatif kuantitatif. Hasil penelitian ini menunjukan bahwa hakim dalam memutuskan perkara pengadilan agama serui mendasarkan pada pasal 39 ayat 2 Undang-Undang No 1 Tahun 1974 dan pasal 19 (f) peraturan pemerintah No 9 Tahun 1975 jo pasal 116 (f) Kompilasi Hukum Islam. Menurut peneliti pertimbangan hukum Hakim dapat dilengkapi dengan pasal-pasal yang terkait dengan kasus perkaranya dalam hal yang terkait kewajiban suami istri. Hasil penelitian menunjukkan bahwa Putusan Pengadila Agama Serui dengan Nomor Perkara 05/Pdt.G/2019/PA.Sri. Hal ini dapat dilihat dari Putusan tersebut yang mengabulkan Gugatan Cerai yang diajukan oleh pihak penggugat terhadap pihak tergugat karena nafkah wajib tidak terpenuhi. |
| Abtrak (Bhs. Inggris) | Humans are creatures that cannot live alone. Humans are created as social beings who need each other. In his life, humans have the desire to socialize with others. This is one of human nature who always wants to be in touch with other humans . Relations between humans are also usually carried out by entering into a marriage. In a marriage it is necessary to have inner and outer love between husband and wife. Providing a living is an obligation that is owned by a husband who in this case is the head of the family in the teachings of Islam. Of course, this obligation should not be neglected or forgotten, given the need that must be fulfilled in a family led by a husband. The formulation of the problem in this research is how is the legal consideration of the judge in deciding the sue divorce case in the Serui Court? The research methodology is a normative juridical approach, descriptive analysis method, secondary data sources, data collection methods using library data, data analysis methods, qualitative normative, quantitative normative. The results of this study indicate that judges in deciding cases of serui religious courts are based on article 39 paragraph 2 of Law No. 1 of 1974 and article 19 (f) of government regulation No. 9 of 1975 in conjunction with article 116 (f) Compilation of Islamic Law. According to researchers, judges' legal considerations can be complemented with articles related to the case in matters related to the obligations of husband and wife. The results showed that the Serui Religious Court Decision with Case Number 05 / Pdt.G / 2019 / PA.Sri. This can be seen from the decision which granted the divorce suit filed by the plaintiff against the defendant because the mandatory income was not fulfilled. |
