| Abstrak (Bhs. Indonesia) | Penelitian ini mengambil judul “EKSEPSI OBSCUUR LIBEL ATAS KELALAIAN ADVOKAT SEBAGAI DASAR GUGATAN TIDAK DAPAT DITERIMA (Studi Putusan Nomor: 10/Pdt.G/2016/PN.Kbm)”, yang bertujuan untuk mengetahui pertimbangan hukum Majelis Hakim Pengadilan Negeri Kebumen dalam mengabulkan eksepsi yang diajukan oleh Tergugat karena gugatan obscuur libel dan akibat hukum terhadap gugatan tidak dapat diterima (Niet Onvankelijke Verklaard). Penelitian ini menggunakan metode yuridis normatif, spesifikasi penelitian preskriptif analitis, teknik pengumpulan data studi kepustakaan dengan inventarisasi, penyajian data teks naratif, analisis data normatif kualitatif. Berdasarkan hasil yang diperoleh penulis melalui penelitian ini, Majelis Hakim mengabulkan eksepsi Tergugat dalam perkara nomor 10/Pdt.G/2016/PN.Kbm pada prinsipnya bukan merupakan penolakan terhadap pokok perkara, akan tetapi karena gugatan mengandung cacat formil sehingga perkara tersebut dihentikan dan putusan belum menyangkut pada pokok perkaranya. Dalam Putusan Nomor 10/Pdt.G/2016/PN.Kbm, Majelis Hakim mendapati fakta bahwa gugatan yang diajukan oleh Penggugat kabur (obscuur libel) karena Penggugat tidak menyebutkan secara eksplisit mengenai Perjanjian Kredit dalam posita (fundamentum petendi), akan tetapi Penggugat dalam petitum meminta Perjanjian Kredit Batal Demi Hukum. Dasar pertimbangan hukum oleh Majelis Hakim telah tepat dan sesuai dengan ketentuan yang berlaku, gugatan yang dinilai kabur merupakan pertimbangan hukum Majelis Hakim dalam menjatuhkan putusan bahwa gugatan tidak dapat diterima. Akibat hukum dari gugatan yang dinyatakan tidak dapat diterima yaitu Penggugat dapat mengajukan gugatan baru dengan jalan memperbaiki gugatan sebelumnya dengan dalil gugatan yang jelas tanpa adanya batasan waktu dalam mengajukannya. |

Inggris) | This research takes the title "OBSCUUR LIBEL'S EXCLUSION OF ADVOCATE'S NEGLIGENCE AS THE BASIS OF UNACCEPTABLE LAWSUIT (Verdict Study Number: 10/Pdt.G/2016/PN.Kbm)", which aims to determine the legal consideration of the Kebumen District Court Of Judges in granting the exception filed by the Defendant due to libel obscuur lawsuit and the legal consequences of the lawsuit is unacceptable (Niet Onvankelijke Verklaard). This research uses normative juridical methods, analytical prescriptive research specifications, literature study data collection techniques with inventory, narrative text data presentation, qualitative normative data analysis. Based on the results obtained by the authors through this study, the Panel of Judges granted the exception of defendants in case number 10/Pdt.G/2016/PN.Kbm in principle is not a rejection of the subject matter, but because the lawsuit contains formil defects until the case is discontinued and the ruling has not concerns the subject matter. In Ruling No. 10/Pdt.G/2016/PN.Kbm, the Panel of Judges found that the claimant's lawsuit wasvague (obscuur libel)because plaintiff did not explicitly mention the Credit Agreement in theposita (fundamentum petendi),but the Plaintiff in petitum requested a Null Credit Agreement for The Law. The basis of legal consideration by the Panel of Judges has been appropriate and in accordance with the prevailing provisions, the lawsuit that is considered vague is the legal consideration of the Panel of Judges in dropping the ruling that the lawsuit is unacceptable. As a result of the lawsuit being declared unacceptable, Plaintiff may file a new lawsuit by correcting the previous lawsuit with clear proof of lawsuit without any time limit in filing it. |
