Indonesia) | PERMOHONAN TALAK KARENA ISTRI BERMAIN ZUMBA (TINJAUAN YURIDIS PUTUSAN PENGADILAN AGAMA KARAWANG NOMOR 2189/PDT.G/2019/PA.KRW) Oleh: Diki Abidin E1A115117 ABSTRAK Pasal 1 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan disebutkan bahwa “Perkawinan ialah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa”, namun dalam praktiknya berumahtangga ini banyak terjadi permasalahan yang berujung perceraian, sehingga tujuan perkawinan tersebut tidak tercapai, seperti Putusan Nomor 2189/Pdt.G/2019/PA.Krw. Permasalahan dalam penelitian ini adalah mengenai pertimbangan hukum Hakim dalam memutus permohonan talak karena istri bermain zumba Pengadilan Karawang: Nomor 2189/Pdt.G/2019/PA.Krw. Metode yang digunakan dalam penelitian ini adalah yuridis normaif, spesifikasi penelitian preskriptif analitis, teknik pengumpulan data studi kepustakaan dengan inventarisasi data, penyajian data dengan teks naratif dan analisis data normatif kualitatif. Berdasarka hasil penelusan dan pembahasan mengenai permohonan talak karena istri bermain zumba terhadap Putusan Pengadilan Negeri Karawang Nomor 2189/Pdt.G/2019/PN/Krw, Berdasarkan hasil penulisan dan pembahasan mengenai permohonan talak pada putusan Pengadilan Negeri Karawang Nomor 2189/Pdt.G/2019/PA.Krw, menunjukan bahwa pertimbangan hukum hakim kurang tepat menggunakan Pasal 19 huruf (f) PP No. 9 tahun 1975 jo. pasal 116 huruf (f) Kompilasi Hukum Islam, seharusnya menggunakan Pasal 19 huruf (a) Peraturan Pemerintah Nomor 9 Tahun 1975. Menurut penulis, sebaiknya pertimbangan Hukum Hakim dalam memutuskan suatu perkara demi tercapainya rasa keadilan, maka menggunakan metode penemuan hukum yaitu interpretasi gramatikal dan interpretasi sistematis dalam perkara ini. Inggris) | DIVORCE REQUESTS BECAUSE WIVES PLAY ZUMBA (JURIDICAL REVIEW OF KARAWANG RELIGIOUS COURT DECISION NOMOR 2189 / PDT.G / 2019 / PA.KRW) Written By : Diki Abidin E1A115117 ABSTRACT Article 1 of Law Number 1 of 1974 Concerning Marriage states that "Marriage is a physical and spiritual bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the Godhead", but in practice This household has many problems that lead to divorce, so that the purpose of the marriage is not achieved, such as Decision Number 2189 / Pdt.G / 2019 / PA.Krw. The problem in this study is regarding the legal considerations of the Judge in deciding the divorce petition because the wife plays zumba Karawang Court: Number 2189 / Pdt.G / 2019 / PA.Krw. The method used in this research is normative juridical, prescriptive analytical research specifications, data collection techniques for library study with data inventory, data presentation with narrative texts and qualitative normative data analysis. Based on the results of the study and discussion regarding the application of divorce because the wife playing zumba against Karawang District Court Decision Number 2189 / Pdt.G / 2019 / PN / Krw. Based on the results of the writing and discussion of the application of divorce in the Karawang District Court decision No. 2189 / Pdt.G / 2019 / PA.Krw, it shows that the legal judgment of judges is not appropriate to use Article 19 letter (f) PP No. 9 of 1975 jo. Article 116 letter (f) Compilation of Islamic Law, should use Article 19 letter (a) Government Regulation Number 9 of 1975. According to the author, judges should consider the legal judgment in deciding a case for the achievement of a sense of justice, then using the method of legal discovery that is grammatical interpretation and systematic interpretation in this case.
