Indonesia) | PENERAPAN PENYIDIKAN LANJUTAN OLEH JAKSA PENUNTUT UMUM DALAM TINDAK PIDANA ILLEGAL LOGGING (STUDI TERHADAP UNDANG-UNDANG NOMOR 18 TAHUN 2013 TENTANG PENCEGAHAN DAN PEMBERANTASAN PERUSAKAN HUTAN) Oleh: SAGITA AULIA RIZQI E1A015054 ABSTRAK Kerusakan hutan saat ini hampir terjadi diseluruh wilayah Indonesia yang diakibatkan oleh tindakan“illegal logging”. Upaya pemerintah dalam mengatasi hal tersebut dengan diaturnya penyidikan lanjutan oleh Jaksa Penuntut Umum. Namun demikian dalam penerapannya menimbulkan persoalan. Tujuan penelitian ini adalah untuk mengetahui penerapan penyidikan lanjutan serta mengetahui bentuk prosedur penyidikan lanjutan yang dilakukan oleh Jaksa Penuntut Umum. Jenis penelitian menggunakan yuridis normatif, dengan metode pendekatan perundang-undangan, dan pendekatan konseptual, dengan spesifikasi penelitian preskriptif, dan sumber bahan hukum primer, sekunder dan tersier. Penyidikan lanjutan yang dilakukan oleh Jaksa Penuntut Umum dalam hal tindak pidana illegal logging berdasarkan ketentuan Undang-Undang No.18 Tahun 2013 tentang Pencegahan dan Pemberantasan Kerusakan Hutan mengatur perihal kewenangan dan jangka waktu pelaksanaan penyidikan lanjutan tersebut yaitu penuntut umum wajib melakukan penyidikan paling lama 20 (dua puluh) hari dan dapat diperpanjang paling lama 30 (tiga puluh) hari dan diaturnya jangka waktu penyidikan dan penyidikan lanjutan, maka akan mendorong terbangunnya sinkronisasi kultural antara lembaga Kepolisian dan Kejaksaan. Prosedur penerapan perpanjangan penyidikan lanjutan oleh Jaksa Penutut Umum dalam kasus tindak pidana Illegal Logging mengatur kewajiban Penuntut Umum untuk melakukan penyidikan lanjutan merupakan langkah progresif dalam upaya percepatan penanganan kasus illegal logging, Prosedur mengenai jangka waktu penyidikan dan penyidikan lanjutan relatif singkat dan Belum adanya peraturan pemerintah yang mengatur mengenai tata cara pelaksanaan Undang-Undang No. 18 Tahun 2013. Penyidikan lanjutan oleh Jaksa Penutut Umum dalam kasus tindak pidana Illegal logging berdasarkan ketentuan Undang-Undang No 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Kerusakan Hutan bertujuan untuk mempercepat penanganan illegal logging dan menjadi solusi dalam penanganan penumpukan perkara ini dikarenakan belum adanya peraturan pemerintah yang mengatur mengenai tata cara pelaksanaan Undang-Undang No. 18 Tahun 2013, jangka waktu penyidikan dan penyidikan lanjutan relatif sangat singkat sehingga tidak sebanding dengan kompleksitas pengungkapan dan pengumpulan alat bukti pada tindak pidana illegal logging. Perlu adanya peraturan lebih lanjut terkait prosedur perpanjangan penyidikan lanjutan itu sendiri yang diamanatkan sesuai ketentuan Undang Undang No.18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan hutan untuk mengisi kekosongan hukum |

Inggris) | THE IMPLEMENTATION OF FURTHER INVESTIGATION IN HANDLING CRIMINAL ACT OF ILLEGAL LOGGING BY PUBLIC PROSECUTOR (STUDY ABOUT LAW NO. 18 OF 2013 CONCERNING THE PREVENTION AND ERADICATION OF FOREST DESTRUCTION) By: SAGITA AULIA RIZQI E1A015054 ABSTRACT Forest destruction occurs in almost all parts of Indonesia as a result of illegal logging. The public prosecutor arranged further investigation as the government's efforts to overcome this problem. However, in practice, it creates problems. The purpose of this study is to determine the application of further investigations and to determine the form of further investigation procedures conducted by the Public Prosecutor. This type of research uses normative juridical, with a statutory approach method, and a conceptual approach, with descriptive research specifications and sources of primary, secondary, and tertiary legal materials. Further investigations carried out by the Public Prosecutor in the case of illegal logging crimes based on the provisions of Law No.18 of 2013 concerning the Prevention and Eradication of Forest Damage regulating the authority and duration of the further investigation, namely the public prosecutor is obliged to investigate for a maximum of 20 ( twenty) days and can be extended for a maximum of 30 (thirty) days and the stipulation of the period of investigation and further investigation will encourage the establishment of a cultural synchronization between the Police and the Prosecutors' Office. The procedure for implementing an extension of further investigations by the General Prosecutor in cases of illegal logging crimes regulates the obligation of the Public Prosecutor to carry out further studies as a progressive step in efforts to accelerate the handling of illegal logging cases. Regulates the procedures for implementing Law no. 18 of 2013. Further investigations by the General Prosecutor in cases of illegal logging crimes based on the provisions of Law No. 18 of 2013 concerning the Prevention and Eradication of Forest Damage aims to accelerate the handling of illegal logging and become a solution in handling the accumulation of these cases due to the absence of government regulations. Which regulates the procedures for implementing Law no. 18 of 2013, the period of investigation and further investigation is relatively short, so it is not comparable with the complexity of the disclosure and collection of evidence in illegal logging. Further regulations are needed regarding the procedure for the extension of the further investigation itself mandated by the provisions of Law No.18 of 2013 concerning the Prevention and Eradication of Forest Destruction to fill the legal vacuum. |
