| Abstrak (Bhs. Indonesia) | Ujaran kebencian yang dilakukan melalui media sosial menimbulkan polemik di kalangan masyarakat. Di satu sisi, perbuatan tersebut merupakan bentuk ekspresi yang berupa curahan hati seseorang. Namun di sisi lain perbuatan tersebut dapat memicu terjadinya kejahatan, permusuhan, dan bahkan perpecahan antar kelompok ataupun individu. Selain itu, kejahatan tersebut dapat berimplikasi pada harkat dan martabat manusia. Tujuan penelitian ini adalah untuk mengetahui proses penyidikan dalam hal mengungkap tindak pidana ujaran kebencian (hate speech) oleh penyidik di Polres Bogor serta hambatan-hambatan yang dialami oleh penyidik dalam proses penyidikan tindak pidana ujaran kebencian (hate speech). Metode pendeketan yang digunakan penelitian ini yaitu yuridis sosiologis. Data penelitian ini berasal dari data primer berupa wawancara dan data sekunder berupa studi kepustakaan yang disusun secara sistematis dan dianalisis dengan metode kualitatfif. Berdasarkan hasil penelitian dan pembahasan, dapat disimpulkan bahwa Polisi Penyidik Unit 1 Satuan Reserse Kriminal Polres Bogor dalam mengungkap tindak pidana ujaran kebencian (hate speech), pada proses penyidikan berpedoman pada empat tahap pokok yaitu, tahap penyelidikan, tahap penindakan, tahap pemeriksaan dan tahap pemberkasan. Guna kepentingan penyidikan, penyidik dapat melakukan tindakan terhadap tersangka yaitu penangkapan, penahanan, penggeledahan, penyitaan dan pemanggilan. Faktor yang menjadi penghambat dalam proses penyidikan yaitu faktor penegak hukum, faktor sarana atau fasilitas. |
| Abtrak (Bhs. Inggris) | Hate speech carried out through social media raises a polemic among the people. On the one hand, the act is a form of expression in the form of a person's heart. But on the other hand these actions can trigger crime, hostility, and even division between groups or individuals. In addition, these crimes can have implications for human dignity. The purpose of this study is to investigate the investigation process in terms of revealing hate speech crimes by investigators at the Bogor Police Station and inhibiting factors obtained by investigators in the hate speech crime investigation process. Judicial sociological approaches have been used in this research. Research data derived from primary data in the form of interviews and secondary data in the form of literature compiled systematically and then analyzed using qualitative methods. Based on the results of research and discussion, it can be concluded that the Police Investigator Unit 1 of Bogor Criminal Investigation Unit in uncovering criminal acts of hate speech. the investigation process is guided by four main stages namely,the stage of investigation, prosecution, examination and filing. For the purposes of investigation, investigators can take action against the suspect, namely arrest,detention, search, seizure and summons. Inhibiting factors in the investigation process are law enforcer, facility and community. |
