Indonesia) | ABSTRAK Pelaksanaan Diversi terhadap Perkara Tindak Pidana Tanpa Hak Menguasai Satwa Dilindungi yang Dilakukan oleh Anak di Wilayah Kepolisian Resor Banyumas Oleh: IVANOVICZ BELINDA OSARINA E1A115015 Bertitik tolak dari kompleksnya permasalahan berkaitan dengan perlindungan yang harus diberikan kepada seorang anak yang berkonflik dengan hukum tentu harus ada upaya dari berbagai pihak untuk menyelamatkan anak bangsa. Solusi yang dapat ditempuh dalam penanganan perkara tindak pidana anak adalah pendekatan restorative juctice, yaitu dilaksanakan dengan cara pengalihan (diversi). Penyidik tindak pidana anak di Polres Banyumas, dituntut mampu melakukan tindakan diversi dalam menangani perkara tindak pidana anak. Pengalihan proses peradilan anak atau yang disebut dengan diversi berguna untuk menghindari efek negatif dari proses-proses peradilan selanjutnya dalam administrasi peradilan anak, misalnya labelisasi akibat pernyataan bersalah maupun vonis hukuman. Metode penelitian yang digunakan adalah yuridis sosiologis, dengan spesifikasi penelitian deskriptif. Sumber data yang digunakan yaitu data primer dan data sekunder kemudian dianalisis dengan metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa pelaksanaan diversi dalam perkara tindak pidana tanpa hak menguasai satwa dilindungi yang dilakukan oleh anak di wilayah hukum Kepolisian Resor Banyumas adalah telah sesuai menurut Pasal 5, 6, 7 dan 8 Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, Peraturan Pemerintah Republik Indonesia Nomor 65 Tahun 2015 tentang Pedoman Pelaksanaan Diversi Dan Penanganan Anak Yang Belum Berumur 12 (Dua Belas) tahun. Faktor pendorong dalam pelaksanaan diversi yaitu, dari pihak orang tua, pihak sekolah, sanggup untuk bersama-sama melakukan pembinaan. Faktor penghambat yaitu, menyatukan pemikiran antara pihak korban dan pihak anak yang berkonflik dengan hukum tidak mudah dan sering terjadi pertengkaran atau keributan diruang diversi. Inggris) | ABSTRACT Diversification of Criminal Acts Without the Rights to Control Protected Animals Commited by Children in the Banyumas District Police Area By: IVANOVICZ BELINDA OSARINA E1A115015 Starting from the complexity of the problems related to the protection that must be given to a child who is in conflict with the law, there must be an effort from various parties to save the nation's children. The solution that can be taken in handling cases of child crime is the restorative juctice approach, which is implemented by diversion. Children criminal investigators, especially in Banyumas Regional Police, are demanded to be able to carry out diversion in handling cases of child crime. Children justice process or known as diversion is useful to avoid the negative effects of subsequent justice processes in the administration of children justice, for example labeling due to statements of guilt or sentencing sentences. The research method used is sociological juridical, with descriptive research specifications. Data sources used are primary data and secondary data and then analyzed by qualitative normative methods. Based on the results of research and discussion, it can be concluded that the implementation of diversion in criminal cases without the right to control protected animals committed by children in the jurisdiction of the Banyumas Police Department is in accordance with Article 5, 6, 7 and 8 of Law Number 11 of 2012 concerning the System Criminal Justice for Children, Government Regulation of the Republic of Indonesia Number 65 of 2015 concerning Guidelines for the Implementation of Diversity and Handling of Children who are not yet 12 years old. The supporting factors in the implementation of diversion is, from the parents, the school, able to jointly provide guidance. The inhibiting factors are uniting thoughts between the victim and the child in conflict with the law is not easy and there are often quarrels or commotion in the diversion room.
