| Abstrak (Bhs. Indonesia) | Permohonan Izin Perkawinan Beda Agama (Tinjauan Yuridis Terhadap Putusan Pengadilan Negeri Blora Nomor 71/Pdt.P/2017/PN Bla.) Oleh : ISKA GINANJAR NUGRAHA E1A112114 ABSTRAK Pasal 2 Ayat (1) Undang-Undang No. 1 Tahun 1974 TentangPerkawinan dijelaskan bahwa Perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agamanya dan kepercayaannya itu. Hal tersebut menjadi dasar yang digunakan oleh masyarakat khususnya WNI yang akan melakukan perkawinan beda agama seperti pada Putusan Pengadilan Negeri Blora Nomor : 71/Pdt.P/2017/PN Bla. Perkawinan beda agama menjadi permasalahan yang cukup serius dikalangan masyarakat Indonesia, selain tidak diatur secara tegas dalam peratura perundang-undangan, hal ini membuat beberapa hakim dalam menangani kasus tersebut memiliki persepsi yang berbeda-beda. Seperti halnya permohonan yang dilakukan oleh pemohon dalam Putusan Pengadilan Negeri Blora Nomor : 71/Pdt.P/2017/PN Bla. Metode pendekatan yang digunakan dalam penelitian ini adalah Yuridis Normatif, spesifikasi penelitian preskriptif analisis, teknik pengumpulan data studi kepustakaan dengan inventarisasi, data yang terkkumpul kemudian disajikan dalam bentuk teks naratif dan analisis normatif kualitatif. Hasil penelitian menunjukan bahwa Majelis Hakim memutuskan perkara mendasarkan pada Pasal 2 ayat (1) UU No. 1 Tahun 1974 tentang Perkawinan. Majelis Hakim dalam mengenakan pasal dalam putusan tersebut hanya menggunakan Pasal 2 ayat (1) UU No. 1 Tahun 1974, yang seharusnya dalam permasalahan perkawinan beda agama ini juga menggunakan Pasal 8 huruf f UU No. 1 Tahun 1974 tentang Perkawinan. By: ISKA GINANJAR NUGRAHA E1A112114 ABSTRACT Article 2 Paragraph (1) of Law No. 1 of 1974 concerning Marriage is explained that marriage is legal, if done according to the law of each religion and his beliefs. it becomes the basis used by the community, especially Indonesian citizens who will interfaith marriages as in the Blora District Court Decree Number: 71 / Pdt.P / 2017 / PN Bla. interfaith marriages become a serious problem among the people of Indonesia, in addition to not being explicitly regulated in legislation, this makes some judges in handling these cases have different perceptions. as with the petition made by the petitioner in the Blora District Court Decision Number: 71 / Pdt.P / 2017 / PN Bla. the method of approach used in this study is Normative Juridical, prescriptive analysis of research specifications, data collection techniques of literature study with an inventory, the collected data is then presented in the form of narrative texts and qualitative normative analysis. the research results show that the Panel of Judges decided the case based on Article 2 paragraph (1) of Law no. 1 of 1974 concerning Marriage. The Panel of Judges in wearing the article in the ruling only uses Article 2 paragraph (1) of Law no. 1 of 1974, which should be in the case of interfaith marriages also uses Article 8 letter f of Law No. 1 of 1974 concerning Marriage.
