| Abstrak (Bhs. Indonesia) | Di era modern saat ini merek mempunyai peranan penting di dunia perdagangan. Salah satu peran penting dari merek adalah sebagai panduan bagi konsumen dalam membedakan antara suatu produk atau jasa yang diproduksi oleh suatu produsen dengan produsen yang lainnya. Indonesia menganut asas first to file dalam proses pendaftaran merek, yang artinya agar hak atas merek itu dapat dilindungi oleh negara Indonesia, maka suatu merek harus sudah terdaftar terlebih dahulu di Indonesia, tetapi walaupun begitu dalam mendaftarkan mereknya di Indonesia pelaku usaha tidak boleh berdasarkan itikad tidak baik, karena dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, permohonan pendaftaran merek harus ditolak jika berdasarkkan itikad tidak baik. Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normatif. Data yang digunakan adalah data sekunder. Spesifikasi penelitian yang digunakan adalah deskriptif analitis. Metode analisis data yang digunakan adalah normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan maka dapat disimpulkan bahwa pembatalan merek “K.BROTHERS COSMETICS” milik Tergugat dalam putusan Mahkamah Agung Nomor 248 PK/pdt.sus-HKI/2018 telah sesuai dengan ketentuan dalam Undang-Undang Nomor 20 Tahun 2016 Tentang Merek Dan Indikasi Geografis. Gugatan didasarkan atas alasan itikad tidak baik yang dilakukan oleh Tergugat dalam mendaftarkan mereknya di Indonesia, saat kedua merek tersebut dibandingkan antara satu dan yang lainnya, terdapat adanya kemiripan antara logo lama merek “K.BROTHERS” milik Penggugat dengan logo “K.BROTHERS COSMETICS” milik Tergugat, serta merek “K.BROTHERS” milik Penggugat yang sudah terdaftar terlebih dahulu di negara asalnya dan di beberapa negara di dunia. |
| Abtrak (Bhs. Inggris) | In the modern era, the trademarks has an important role in the world of commerce. One important role of a brand is as an alloy for consumers in distinguishing between a product or service produced by a producer with other producers. Indonesia adheres to the principle of first to file in the process of trademark registration, which means that the rights to the mark can be protected by the Indonesian state, a trademark must have been registered first in Indonesia, but business actors in registering its mark in Indonesia must not be based on a badfaith, because in trademarks and geographical indications act number 20 of 2016, applications for trademark registration must be rejected if based on badfaith. The method used in this research is normative juridical method. The data used is secondary data. The research specifications used are descriptive analytical. The data analysis method used is qualitative normative. Based on the results of research and discussion, it can be concluded that the cancellation of the trademark "K.BROTHERS COSMETICS" owned by the Defendant in the Supreme Court's decision No. 248 PK / pdt.sus-HKI / 2018 is in accordance with the provisions in trademarks and geographical indications act number 20 of 2016. The lawsuit was based on the reasons of bad faith committed by the Defendant in registering their trademark in Indonesia, when the two brands were compared between one and the other, there was a similarity between the plaintiff's old "K.BROTHERS" brand logo and the "K.BROTHERS COSMETICS" logo. Defendant's property, as well as the Plaintiff's "K.BROTHERS" mark which is registered in his home country and in several countries in the world. |
