Indonesia) | ABSTRAK TEKNIK PENYELESAIAN TINDAK PIDANA PENGANIAYAAN YANG DILAKUKAN OLEH ANAK MELALUI DIVERSI (Studi Kasus di Polres Kota Tasikmalaya) Oleh : Dhela Megalia Putri E1A015237 Tindak pidana yang dilakukan oleh anak tidak sepenuhnya menjadi tanggung jawab anak tersebut karena dari sisi psikologis dan kemampuan berfikir anak masih belum terbentuk secara sempurna. Oleh karena itu perlu ada mekanisme yang secara terstruktur untuk melindungi anak sebagai pelaku tindak pidana tanpa mengesampingkan korban dan masyarakat. Terhadap kasus tindak pidana penganiayaan yang dilakukan oleh Y (17) atas korban M (14) menurut ketentuan Undang – Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak mengatur secara khusus bahwa anak yang berhadapan dengan hukum pada tingkat penyidikan, penuntutan dan pemeriksaan perkara di pengadilan wajib diupayakan diversi. Diversi merupakan pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana. Dengan adanya diversi yaitu untuk mencapai perdamaian antara korban dan pelaku serta menghindarkan anak dari efek negatif peradilan pidana dan mendorong masyarakat untuk berpartisipasi serta menanamkan rasa tanggung jawab kepada anak. Tujuan penelitian ini untuk mengetahui teknik penyelesaian tindak pidana penganiayaan yang dilakukan oleh anak melalui diversi dan untuk mengetahui hambatan yang dihadapi penyidik dalam penyelesaiannya. Metode penelitian yang digunakan adalah yuridis sosiologis dengan spesifikasi penelitian deskriptif. Jenis data yang digunakan yaitu data primer dan data sekunder. Teknik pengumpulan data yang digunakan yaitu studi kepustakaan, dan wawancara dengan informan. Hasil dari penelitian bahwa penyidik anak bagian Unit Pelayanan Perempuan dan Anak (UPPA) di Polres Kota Tasikmalaya sudah melakukan penyelesaian tindak pidana melalui diversi dengan cara musyawarah antara pelaku dan korban yang masing-masing didampingi orang tua/wali, dihadiri pihak penyidik, pembimbing kemasyarakatan dan pekerja sosial profesional. Perkara penganiayaan yang dilakukan anak pada tahun 2016-2019 terjadi 7 (tujuh) kasus yang berhasil diselesaikan melalui upaya diversi dan 2 (dua) kasus gagal diupayakan diversi. Inggris) | ABSTRACT Technique Completion Criminal Act Mistreatment That Committed By Children Through Diversion (Case Study in Tasikmalaya City Police) By: Dhela Megalia Putri E1A015237 Criminal act committed by children is not entirely the responsibility of the child because from of the child’s psychological side and thinking ability are still not formend perfectly. Therefore, there needs to be a structured mechanism protect children as criminal offender without putting victims and the community. Against criminal cases mistreatment committed by Y (17) for the victim M (14) in accordance with the provisions of Law Number 11 of 2012 about Child Criminal Justice System specifically regulate that children in conflict with the law at the level of investigation, prosecution and examination of children cases in district courts must be pursued diversion. Diversion is a child's diversion settlement of the criminal justice process to outside the criminal justice process. With the diversion that is to achieve peace between victims and perpetrators and prevent children from the negative effects of criminal justice and encourage the community to participate and instill a sense of responsibility to children. The purpose of this study for know technique completion criminal act mistreatment that committed by children through diversion and to know the obstacles facing the investigator in its completion. The research method used is sosiological juridical with descriptive research specifications. The types of data use are primary data and secondary data. Data collection techniques used was literature studies, and interviews with informants. The results of the study that the child investigation of the Women’s and Children’s service unit (UPPA) at the police station Tasikmalaya City has done completion of the offense by the diversion by means of consultation between the perpetrator and the victim are each accompanied by a parent / guardian, attended by the investigator, supervisor of community and professional social workers. Case of child maltreatment in 2016-2019 occurred seven (7) cases were successfully resolved through the efforts of diversion and two (2) cases of attempted diversion fails.
