| Abstrak (Bhs. Indonesia) | Kasus rasisme banyak terjadi dan menimpa kaum minoritas dalam sepak bola Eropa, khususnya yang berasal dari benua Asia dan Afrika yang mencoreng nama baik Fédération Internationale de Football Association (FIFA) ataupun Union the European Football Association(UEFA). Sebagai badan tertinggi yang mengurus dan mengawasi sepak bola di Eropa, UEFA mempunyai sebuah peraturan yang dinamakan UEFA Disciplinary Regulation. Dalam peraturan tersebut, dimuat beberapa ketentuan yang salah satunya termasuk ketentuan larangan tindakan rasisme. Kasus rasisme masih sering terjadi, walaupun sudah ada ketentuan larangan tindakan rasisme. Misalnya pada tahun 2018, Kalidou Koulibaly mendapat perlakuan rasis di Italia oleh pendukung Inter Milan. Hal itu selain melanggar ketentuan UEFA Disciplinary Regulation, juga melanggar ketentuan-ketentuan internasional tentang hak asasi manusia lainnya. Penelitian ini merupakan penelitian yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan kasus, spesifikasi penelitian adalah deskriptif analitis. Jenis data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Data sekunder yang telah terkumpul disajikan dalam bentuk naratif serta dianalisis dengan metode normatif kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa masyarakat internasional sudah memiliki ketentuan-ketentuan internasional yang membahas tentang hak asasi manusia, khususnya larangan diskriminasi dan rasisme. Di antaranya terdapat dalam International Covenant on Civil and Political Rights1966 (ICCPR) dan Universal Declaration of Human Rights1948 (UDHR). Selain itu, terdapat ketentuan regional mengenai hak asasi manusia di negara-negara Eropa, Afrika, Asia, Amerika, dan juga Timur Tengah. Dalam kasus Koulibaly, ketentuan yang dilanggar adalah Pasal 14 ayat (2) UEFA Disciplinary Regulation, sehingga sesuai dengan peraturan itu, Federacione Italiana Giuoco Calcio(FIGC) menjatuhkan sanksi kepada pendukung Inter Milan dengan tidak boleh datang ke Stadion Giuseppe Meazzaselama dua pertandingan dan ditambah pengosongan tribun utara Stadion (Curva Nord). |

Inggris) | Many cases of racism occur and afflict minorities in European football, especially those from the continents of Asia and Africa who have tarnished the good name of the Fédération Internationale de Football Association (FIFA) or the Union of European Football Association (UEFA). As the highest body that manages and oversees football in Europe, UEFA has a regulation called the UEFA Disciplinary Regulation. In the regulation, several provisions are included, one of which includes a prohibition on racism. Although there are provisions to prohibit racism, racism still frequently occurs. For example in 2018, Kalidou Koulibaly received racist treatment in Italy by Inter Milan supporters. Besides violating the UEFA Disciplinary Regulations, it also violates other international human rights provisions. This study is a normative juridical research and theapproach method are a statute approach and case approach. The research specifications uses descriptive analytical. The type of data used by writer is secondary data consisting of primary, secondary, and tertiary legal materials. Secondary data that has been collected is presented in the form of narrative and analyzed by qualitative normative methods. The results of research indicate that the international community already has international provisions that discuss human rights, specifically the prohibition of discrimination and racism. These include the Universal Declaration of Human Rights 1948 (UDHR) and International Covenant on Civil and Political Rights 1966 (ICCPR). In addition, there are regional provisions regarding human rights in European, African, Asian, American and Middle Eastern countries. In the Koulibaly case, the provisions violated were Article 14 paragraph (2) of the UEFA Disciplinary Regulation, so that according to the regulations, Federacione Italiana Giuoco Calcio (FIGC) imposed sanctions on Inter Milan supporters by not being allowed to come to the Giuseppe Meazza Stadium for two matches and added emptying the stands north of the stadium (Curva Nord). |
