| Abstrak (Bhs. Indonesia) | Perlindungan konsumen bertujuan untuk melindungi dan terpenuhinya hak konsumen, namun pada kenyataannya tujuan tersebut sulit untuk dicapai, seperti yang terjadi pada putusan BPSK Nomor: 02/PTS.ARB/BPSK/XII/2011 tentang perlindungan konsumen. Metode yang digunakan dalam penelitian adalah Yuridis Normatif dengan menggunakan pendekatan undang-undang, historis dan analisis, spesifikasi penelitian Deskriptif analitis, metode pengumpulan data studi kepustakaan dengan inventaris, data yang terkumpul kemudian disajikan dalam bentuk teks naratif dan analisis normatif kualitatif. Kesimpulan hasil penelitian menujukan bahwa pelaku usaha ikut bertanggung jawab dalam perbuatan melawan hukum yang dilakukan oleh orang dalam pengawasannya, sehingga pelaku usaha tidak dapat mengelak dari tanggung jawab yang harus dilaksanakan atas kerugian yang diderita oleh konsumen atas perbuatan melawan hukum yang dilakukan oleh orang dalam pengawasannya. |

Inggris) | Consumer protection aims to protect and fulfill consumer rights, but in reality these goals are difficult to achieve, as happened in the decision of BPSK Number: 02 / PTS.ARB / BPSK / XII / 2011 concerning consumer protection. The method used in this research is Normative Juridical by using a legal, historical and analytical approach, Descriptive analytical research specifications, a method of collecting literature study data with inventory, the collected data is then presented in the form of narrative texts and qualitative normative analysis. The conclusion of the research result is that the businessmen are responsible in the act against the law carried out by people in their supervision, so that the businessmen cannot evade the responsibility that must be carried out for the loss suffered by the consumer for the unlawful act carried out by the person under his supervision. |
