| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini dilakukan terhadap perkara dan Putusan Pengadilan Nomor 153/Pdt.G/2018/PN.Blb, yaitu mengenai gugatan perbuatan melawan hukum terhadap pelaksanaan eksekusi objek hak tangungan. Permasalahan yang diajukan dalam penelitian ini adalah : 1. Bagaimanakah hak dan kewenangan kreditur penerima hak tanggungan untuk melakukan parate eksekusi atas objek hak tanggungan dalam hal debitur melakukan wanprestasi dan 2. Bagaimanakah kewajiban debitur pemberi hak tanggungan dalam pelaksanaan parate eksekusi atas objek hak tanggungan. Adapun tujuan penelitiannya adalah : melakukan analisis terhadap hak dan kewenangan kreditur penerima hak tanggungan untuk melakukan parate eksekusi atas objek hak tanggungan dalam hal debitur melakukan wanprestasi dan melakuan analisis terhadap kewajiban debitur pemberi hak tanggungan dalam pelaksanaan parate eksekusi atas objek hak tanggungan. Metode penelitian yang digunakan adalah metode yuridis normatif, dengan spesifikasi penelitian diskriptif analitis dan analisis secara kualitatif. Berdasarkan hasil analisis diperoleh hasil bahwa: pertama, Dalam hal debitur pemberi hak tanggungan melakukan wanprestasi, kreditur penerima hak tanggungan mempunyai hak dan kewenangan untuk melakukan eksekusi objek hak tanggungan, salah satunya dengan menggunakan parate eksekusi, tanpa perlu meminta ijin kepada debitur dan meminta fiat eksekusi dari Pengadilan Negeri. Dan kedua, Kewajiban seorang debitur pemberi hak tanggungan dalam pelaksanaan parate eksekusi adalah membiarkan, memberikan kesempatan atau tidak menghalang-halangi kreditur dalam pelaksanaan eksekusinya. Tindakan debitur yang mengajukan gugatan tanpa alasan yang dapat dibenarkan oleh hukum, dapat dikategorikan telah menghalang-halangi pelaksanaan eksekusi hak tanggungan. |
