Indonesia) | PERMOHONAN ITSBAT NIKAH (Tinjauan Yuridis Putusan Pengadilan Agama Jakarta Selatan Nomor :3076/Pdt.G/2018/PA.JS) Oleh : Estatika Permatasari NIM : E1A112094 ABSTRAK Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Kompilasi Hukum Islam telah mengatur berbagai aturan mengenai perkawinan demi tercapainya tujuan dilakukannya perkawinan, didukung oleh Peraturan Pemerintah Nomor 9 Tahun 1975 Pasal 2 Tentang Pelaksanaan Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan , seperti salah satu perkara yang terjadi di Pengadilan Agama Jakarta Selatan dengan Nomor : 3076/Pdt.G/2018/PA.JS. Permasalahan dalam penelitian ini adalah bagaimana pertimbangan Hukum Hakim dalam mengabulkan permohonan Itsbat Nikah pada penetapan Pengadilan Agama Jakarta Selatan Nomor: 3076/Pdt.G/2018/PA.JS. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, spesifikasi penelitian ini adalah preskriptif analisis, metode pengumpulan data studi kepustakaan dengan inventarisasi, metode analisis data normatif kualitatif. Hasil penelitian menunjukan bahwa Hakim dalam melakukan pertimbangan dalam Putusan Pengadilan Agama Jakarta Selatan Nomor : 3076/Pdt.G/2018/PA.JS merujuk pada Undang-undang Nomor 1 Tahun 1974 dan Pasal 7 ayat (3) huruf (e) ,dan berdasarkan Pasal 34 ayat (1) Undang-Undang Nomor 23 Tahun 2006 Tentang Administrasi Kependudukan. Menurut peneliti, telah memenuhi syarat perkawinan sesuai dengan ketentuan yang diatur oleh Agama dan Perundang-undangan yang berlaku. Kata Kunci : Permohonan Itsbat Nikah |

Inggris) | APPLICATION OF ITSBAT NIKAH (Juridical Review of the Decision of the South Jakarta Religious Court Number: 3076 / Pdt.G / 2018 / PA.JS) By: Estatika Permatasari NIM : E1A112094 ABSTRACT Law Number 1 Year 1974 concerning Marriage and Compilation of Islamic Law has regulated various rules regarding marriage to achieve the goal of marriage, supported by Government Regulation Number 9 of 1975 Article 2 concerning Implementation of Law Number 1 of 1974 concerning Marriage, as wrong one case that occurred in the South Jakarta Religious Court Number: 3076 / Pdt.G / 2018 / PA.JS. The problem in this research is how Judges' Legal considerations in granting the application for Itsbat Marriage in the determination of the South Jakarta Religious Court Number: 3076 / Pdt.G / 2018 / PA.JS. The approach method used in this study is a normative juridical approach, the specification of this study is prescriptive analysis, a method of collecting library data with an inventory, a method of qualitative normative data analysis. The results of the study indicate that the Judge in carrying out his considerations in the stipulation of the South Jakarta Religious Court Number: 3076 / Pdt.G / 2018 / PA.JS refers to Law Number 1 Year 1974 and Article 7 paragraph (3) letter (e), and based on Article 34 paragraph (1) of Law Number 23 Year 2006 concerning Population Administration. According to the researcher, it has fulfilled the marriage requirements in accordance with the provisions regulated by Religion and the applicable Laws. Keywords: Application for Itsbat Marriage |
