| Abstrak (Bhs. Indonesia) | Pembuktian adalah hal terpenting dalam hukum acara pidana dimana dalam suatu pembuktian akan ditentukan hukuman serta nasib yang akan diterima oleh seorang terdakwa dalam suatu persidangan sebagai akibat dari perbuatannya. Dalam suatu pembuktian hak-hak asasi serta nasib seorang terdakwa benar-benar akan ditentukan sehingga dalam pelaksanaan pembuktian harus sesuai dengan Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana agar terdakwa benar-benar mendapat hukuman sesuai dengan perbuatannya yang dengan seadil-adilnya hingga tidak memberatkan maupun meringankannya. Tindak pidana pembunuhan yang terdapat dalam Putusan Pengadilan Negeri Nomor 669/PID.B/2014/PN. TNG. perlu dilihat bagaimana pembuktiannya dalam putusan tersebut serta apa akibat hukum yang timbul dari putusan tersebut bagi terdakwa. Dalam pembuktian tindak pidana pembunuhan yang terdapat dalam Putusan Pengadilan Negeri Nomor 669/PID.B/2014/PN.TNG. terdapat tiga alat bukti sehingga sudah melebihi batas minimal pembuktian menurut Pasal 183 KUHAP yaitu minimal terdapat dua alat bukti yang sah disertai dengan adanya keyakinan hakim, alat bukti yang terdapat dalam putusan adalah keterangan saksi yang terdiri dari 4 orang saksi serta 2 orang saksi Ade Charge, alat bukti surat Visum Et Repertum, dan alat bukti keterangan terdakwa, yang mana dengan ini sudah melebihi batas minimum pembuktian yaitu dua alat bukti menurut Pasal 183 KUHAP. Dan setelah alat-alat bukti tersebut dihubungkan dengan unsur-unsur yang ada dalam Pasal 338 KUHP hakim memperoleh keyakinan bahwa terdakwa terbukti bersalah melakukan tindak pidana pembunuhan dan akibat hukum dari putusan tersebut kepada terdakwa adalah jatuhnya putusan pemidanaan yang dimana akan menghukum terdakwa atas perbuatannya melakukan tindak pidana pembunuhan. In a proof of human rights and the fate of a defendant, it will be determined so that the implementation of the evidence must be in accordance with Law Number 8 of 1981 concerning the Criminal Procedure Code so that the defendant is punished according to his actions as fairly as possible. does not burden or alleviate it. Criminal killings contained in the District Court Decision Number 669 / PID.B / 2014 / PN. TNG. it needs to be seen how the evidence in the decision and the legal consequences arising from the ruling for the defendant. In proving the crime of murder contained in the District Court Decision Number 669 / PID.B / 2014 / PN.TNG. there are three evidences that have exceeded the minimum proof limit according to Article 183 of the KUHAP, namely that there are at least two valid evidences accompanied by a judge's conviction, the evidence contained in the verdict is a witness statement consisting of 4 witnesses and 2 witnesses Ade Charge, Visum Et Repertum letter of evidence, and evidence of the defendant's evidence, which by this has exceeded the minimum proof limit, namely two instruments according to Article 183 of the Criminal Procedure Code. And after the evidence connected with the elements in Article 338 of the Criminal Code the judge found that the defendant was found guilty of a crime of murder and the legal consequence of the verdict to the defendant was the fall of the sentencing sentence which would punish the defendant for acting criminal murder.
