| Abstrak (Bhs. Indonesia) | Skripsi ini membahas mengenai diversi dalam perkara tindak pidana kekerasan terhadap anak yang dilakukan secara bersama-sama (Studi di Polres Banyumas & Bapas purwokerto). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder, dan bahan-bahan nonhukum yang diolah serta dianalisis secara preskripsi. Hasil penelitian ini menyimpulkan bahwa: Mekanisme diversi dalam perkara tindak pidana kekerasan terhadap anak yang dilakukan secara bersama-sama di Polres Banyumas adalah: Pihak Kepolisian (Penyidik) memanggil pelaku, korban, keluarga korban dan pelaku, serta pihak-pihak yang terkait untuk melaksanakan diversi, saat diversi dilakukan Pembimbing Kemasyarakatan membacakan hasil Penelitian Kemasyarakatan yang telah dilakukan di hadapan para pihak yang hadir pada diversi tersebut. Apabila proses diversi berhasil mencapai kesepakatan, Penyidik menyampaikan Berita Acara Diversi beserta Kesepakatan Diversi kepada Ketua Pengadilan Negeri untuk dibuatkan Penetapan, apabila proses diversi gagal maka diversi akan dilanjutkan ke tahap selanjutnya yakni proses penuntutan dan pemeriksaan di pengadian negeri. Bentuk pembinaan melalui program diversi kepada pelaku tindak pidana kekerasan terhadap anak yang dilakukan secara bersama-sama di Bapas Purwokerto adalah para pelaku diberi kewajiban untuk apel ke Bapas Purwokerto setiap bulan sekali selama kurun waktu 3 bulan, saat, menjalani apel di Bapas Purwokerto para pelaku diberikan konsultasi dengan tujuan (memperbaiki sikap dan perilaku keseharian, memperbaiki relasi sosial terhadap keluarga dan masyarakat, mematuhi ketentuan/peraturan yang ada baik di Bapas Purwoketo, keluarga maupun masyarakat, pemberian nasehat untuk beribadah secara rutin). |

| Abtrak (Bhs. Inggris) | This thesis discusses the diversion in cases of criminal acts of violence against children carried out jointly (Study at Banyumas & Bapas Purwokerto Regional Police). The research method used in this study is normative legal research using secondary data which includes primary legal materials, secondary legal materials, and non-legal materials that are processed and analyzed in a prescription manner. The results of this study concluded that: The mechanism of diversion in cases of criminal acts of violence against children carried out jointly at the Banyumas Regional Police Station was: The Police (Investigators) summoned the perpetrators, victims, families of victims and perpetrators, and related parties to carry out diversion , when the diversion was carried out the Community Advisor read out the results of the Social Research conducted in the presence of the parties present on the diversion. If the diversion process is successful in reaching an agreement, the Investigator delivers News of the Diversion Event along with the Diversity Agreement to the Head of the District Court to make a Determination, if the diversion process fails then the diversion will proceed to the next stage, namely the prosecution and inspection process at the state court. Forms of coaching through a diversion program to perpetrators of violence against children committed jointly in Bapas Purwokerto were the perpetrators given the obligation to bake apples to Bapas Purwokerto every month for a period of 3 months, when, taking an apple in Bapas Purwokerto the perpetrators were given consultation with objectives (improving daily attitudes and behavior, improving social relations with family and community, complying with existing regulations / regulations both in Purwakarta, Bapas, family and community, giving advice to worship regularly). |
