Indonesia) | ABSTRAK Undang-undang Perkawinan Pasal 7 ayat (2) mengatur tentang Dispensasi Perkawinan, dimana Dispensasi Perkawinan diajukan ke Pengadilan Agama oleh orang tua kandung dari calon mempelai yang akan dikawinkan, Perkawinan tersebut sangat mendesak dilangsungkan karena calon mempelai perempuan telah melahirkan seorang anak, maka dari itu pihak keluarga kedua-belah pihak sudah sepakat untuk segera menikahkan anak mereka untuk menghindari hal-hal yang tidak diharapkan. Perumusan masalah yaitu Bagaimana pertimbangan hukum hakim dalam mengabulkan Permohonan Dispensasi Perkawinan terhadap Penetapan Pengadilan Agama Kediri Nomor. 0407/Pdt.P/2017/PA.Kab.Kdr., Peneliti menggunakan metode pendekatan yuridis normatif, spesifikasi penelitian preskriptif analitis, pengumpulan data studi kepustakaan dengan inventarisasi data, analisis data normatif kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan hukum hakim dalam mengabulkan Permohonan Dispensasi Perkawinan terhadap Penetapan Pengadilan Agama Kediri No. 0407/Pdt.P/2017/PA.Kab.Kdr berdasarkan pada ketentuan Pasal 7 ayat (1) dan (2), Pasal 6 dan Pasal 9 Undang-Undang Nomor 1 Tahun 1974. Hakim sebaiknya mempertimbangkan Pasal 8 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan mengenai larangan perkawinan, dan Pasal 15 ayat (1) Kompilasi Hukum Islam. |

Inggris) | ABSTRACT Marriage Law Article 7 paragraph (2) regulates Marriage Dispensation, where Marriage Dispensation is submitted to the Religious Court by the biological parents of the prospective bride to be married, the marriage is very urgent because the prospective bride has given birth to a child, therefore the family both parties agreed to immediately marry off their child to avoid unexpected things. Formulation of the problem is how is the legal consideration of the judge in granting the Application for Marriage Dispensation to the Determination of the Kediri Religious Court Number. 0407 / Pdt.P / 2017 / PA.Kab.Kdr., The researcher used the normative juridical approach method, the specification of analytical prescriptive research, library data collection data collection with data inventory, qualitative normative data analysis. The results of the study indicate that the legal considerations of the judge in granting the Application for Marriage Dispensation to the Determination of the Kediri Religious Court No. 0407 / Pdt.P / 2017 / PA.Kab.Kdr based on the provisions of Article 7 paragraph (1) and (2), Article 6 and Article 9 of Act Number 1 of 1974. Judges should consider Article 8 of Act Number 1 In 1974 concerning Marriage concerning the prohibition of marriage, and Article 15 paragraph (1) Compilation of Islamic Law. |
