| Abstrak (Bhs. Indonesia) | Perlindungan hukum bersumber dari konsep pengakuan dan perlindungan yang merupakan tugas pemerintah, salah satunya terhadap Pegawai Negeri Sipil. Tujuan pemberian perlindungan hukum yang diberikan pemerintah kepada Pegawai Negeri Sipil adalah menjadikan kepentingan kepegawaian yang dilindungi dalam hak hukum yang dimiliki oleh Pegawai Negeri Sipil untuk pelayanan publik yang profesional. Berdasarkan Peraturan Pemerintah Nomor 11 Tahun 2017 Tentang Manajemen Pegawai Negeri Sipil, jaminan pensiun menjadi salah satu dari bentuk perlindungan yang diberikan pemerintah kepada Pegawai Negeri Sipil yang memenuhi syarat untuk pensiun melalui skema pensiun. Pemberian jaminan pensiun merupakan hak setiap Pegawai Negeri Sipil dalam bekerja dan merupakan hal yang wajib dipenuhi pemerintah. Metode Penelitian yang digunakan dalam penelitian ini adalah menggunakan Metode Pendekatan Yuridis Normatif. Data yang digunakan adalah data sekunder berupa buku-buku literatur, peraturan perundang-undangan, dokumen resmi, jurnal ilmiah, dan hasil wawancara dengan cara studi putaka. Data-data tersebut dikumpulkan yang kemudian disajikan dalam bentuk uraian sistematis. Data-data yang diperoleh dianalisis dan dijabarkan berdasarkan norma hukum yang berkaitan dengan objek penelitian. Pemberian jaminan pensiun Pegawai Negeri Sipil di Indonesia dilakukan melalui garis koordinasi dari pusat ke daerah berdasarkan otonomi daerah agar merata dan sesuai anggaran negara. Sistem pay as you go tidak memenuhi kesejahteraan Pegawai Negeri Sipil karena besaran iuran sama dengan besarnya manfaat pensiun yang dibayarkan. Sistem fully funded lebih efektif karena dana pensiun yang berasal dari iuran pegawai selama masa kerja dan iuran pemerintah dalam mencapaian kesejahteraan hidup pegawai negeri sipil yang sudah melewati masa aktif bekerja. |
| Abtrak (Bhs. Inggris) | Legal protection comes from the concept of recognition and protection which is the duty of the government, one of which is the Civil Servants. The purpose of providing legal protection provided by the government to the Civil Servants is to make the employee's interests protected in the legal rights held by the Civil Servants for professional public services. Based on Government Regulation Number 11 of 2017 concerning Management of Civil Servants, pension insurance is one of the forms of protection provided by the government to Civil Servants who meet the conditions for retirement through a pension scheme. The granting of a pension guarantee is the right of every civil servant to work and is a matter that must be fulfilled by the government. Metode used in this study is a research method by using juridical - normative. The data used are secondary data in the form of literature books, legislation, official documents, scientific journals, and interview results by way of literature review. The data is collected which is then presented in the form of a systematic description. The data obtained were analyzed and explained based on legal norms related to the object of research. Provision of a civil servant pension guarantee in Indonesia is carried out through a coordination line from the center to the regions based on regional autonomy so that it is evenly distributed and in accordance with the state budget. The pay as you go system does not fulfill the welfare of Civil Servants because the amount of contributions is the same as the amount of pension benefits paid. The fully funded system is more effective because pension funds are derived from employee contributions during the work period and government contributions in achieving the welfare of civil servants who have passed the active period of work. |
