| Abstrak (Bhs. Indonesia) | Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan telah mengatur berbagai aturan mengenai perkawinan demi tercapainya tujuan dilakukannya perkawinan, namun pembuat undang-undangpun memberikan celah untuk menyimpangi beberapa aturan seperti ketentuan Pasal 7 ayat (1) yang mengatur batasan usia melangsungkan perkawinan, yaitu Pasal 7 ayat (2). Pasal 7 ayat (2) merupakan pengecualian umur yang sudah ditetapkan dan secara jelas Pasal 7 ayat (2) membenarkan kemungkinan melakukan dispensasi terhadap usia perkawinan, seperti salah satu perkara yang terjadi di Pengadilan Agama Cianjur dengan Nomor Perkara : 1761/Pdt.P/2017/PA.Cjr. Permasalahan dalam penelitian ini adalah bagaimana pertimbangan Hukum Hakim dalam mengabulkan permohonan perkawinan di bawah umur terhadap Penetapan Pengadilan Agama Cianjur Nomor 1761/Pdt.P/2017/PA.Cjr. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, Spesifikasi penelitian preskriptif analisis, metode pengumpulan data studi kepustakaan dengan inventarisasi, metode analisis data normatif kualitatif. Hasil penelitian menunjukan bahwa hakim dalam melakukan pertimbangannya mendasarkan pada Pasal 7 ayat (2) Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan, kaidah Islam (hifz al-hurmah), Hadits Nabi (HR. Bukhari no. 5065 dan Muslim no. 1400), Pasal 8 dan 9 Undang-Undang Nomor 1 Tahun 1974 jo. Pasal 39 Kompilasi Hukum Islam. Menurut peneliti hakim dalam melakukan pertimbangannya tidak selalu mengutamakan untuk menghindari kemadharatan saja, melainkan juga mempertimbangkan manfaat setelah melangsungkan perkawinan sesuai dengan tujuan perkawinan. Inggris) | UNDERAGE MARRIAGE (Juridical review of the determination of the Cianjur Religious Court Number 1761 / Pdt.P / 2017 / PA.Cjr) By: Muhammad Ilham Yunus NIM: E1A014143 ABSTRACT Act Number 1 of 1974 concerning Marriage has regulated various rules regarding marriage in order to achieve the goal of marriage, but the legislators also provide a loophole to deviate from several rules such as the provisions of Article 7 paragraph (1) which regulate the age limit for marriage, namely Article 7 paragraph (2). Article 7 paragraph (2) is an exception for the age that has been determined and clearly Article 7 paragraph (2) justifies the possibility of doing dispensation for the age of marriage, such as one of the cases that occurred in the Cianjur Religious Court with Case Number: 1761 / Pdt.P / 2017 /PA.Cjr. The problem in this study is how Judges' Legal considerations in granting underage marriage requests towards the Determination of the Cianjur Religious Court Number 1761 / Pdt.P / 2017 / PA.Cjr. The approach method that used in this study is a normative juridical approach, the specification of prescriptive analysis research, the method of collecting literature study data with inventorize, the method of qualitative normative data analysis. The results of the research showed that the judges doing their considerations based on Article 7 paragraph (2) of Act Number 1 of 1974 concerning Marriage, Islamic rules (hifz al-hurmah), Hadith of the Prophet (HR Bukhari number 5065 and Muslimah Number 1400) , Articles 8 and 9 of Act Number 1 of 1974 jo. Article 39 Compilation of Islamic Law. According to the researcher of judge, in order doing their considerations, they did not always prioritize avoiding something that is not profitable, but also considered the benefits of having married according to the purpose of marriage.
