| Abstrak (Bhs. Indonesia) | PERLINDUNGAN HUKUM TERHADAP PT. SYNTHESIS KARYA PRATAMA SEBAGAI PELAKU USAHA BERDASARKAN UNDANG-UNDANG NOMOR 8 TAHUN 1999 TENTANG PERLINDUNGAN KONSUMEN DALAM PUTUSAN MA NOMOR 757 K/PDT.SUS-BPSK/2016 ABSTRAK Perkembangan perekonomian nasional mempunyai arti yang sangat penting untuk dapat memajukan kehidupan warga masyarakatnya dalam berbangsa dan bernegara. Penyokong dari perkembangan perekonomian nasional salah satunya dilakukan oleh Pelaku Usaha. Pelaku Usaha menyediakan barang dan/atau jasa guna memenuhi kebutuhan dari Konsumennya. Adapun dalam skripsi membahas mengenai perlindungan hukum terhadap Pelaku Usaha penyedia rumah susun, di mana terdapat permasalahan Konsumen yang telah memesan sebuah satuan rumah susun kepada Pelaku Usaha berhenti membayar kredit satuan rumah susun yang mengakibatkan Pelaku Usaha mengalami kerugian, dalam hal ini Pelaku Usaha yaitu PT. Synthesis Karya Pratama dan Asriani Aminah yang tidak lain adalah sebagai Konsumen. Pada penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan. Data yang digunakan dalam penelitian kali ini yaitu data sekunder. Pengumpulan data melalui studi kepustakaan terhadap peraturan perundang-undangan yang terkait. Data diuraikan dalam bentuk teks naratif secara sistematis. Metode analisis data yang digunakan adalah metode normatif kualitatif. Hasil penelitian menunjukan bahwa Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen tidak hanya melindungi Konsumen saja, tetapi melindungi Pelaku Usaha yang dirugikan oleh Konsumen hal ini diatur dalam Pasal 6 UUPK. |

SYNTHESIS KARYA PRATAMA AS A BUSINESS ACTOR BASED ON CONSTITUTION NUMBER 8 OF 1999 ABOUT CONSUMER PROTECTION IN THE DECISION OF SUPREME COURT NUMBER 757 K/PDT.SUS-BPSK/2016 ABSTRACT The development of national economy has a really important meanings in order to be able to advance the lives of its citizen in becoming nation and state citizens. One of the stimulus of a national economy’s development is done by the business actors. The business actor itself provides goods and/or services in order to fulfill the needs of the consumers. As for in this thesis, it is described and discussed about the legal protection of a business actor, which is a flats provider, where there is a problem spesifically a consumer who has reserved one unit of flat to the mentioned business actor but then stopped doing payments for that unit of flat and caused the business actor to endure losses. In this case, the business actor is PT. Synthesis Karya Pratama and Asriani Aminah which is none other than as the consumer. This research uses normative juridical method with legislation approach. The data used in this research is secondary data. The data collecting method is using literature study through the related laws and regulations. The data itself is outlined in the form of narrative text sistematically. And the data analysis method used in this research is qualitative normative method The result of this research showed that Constitution Number 8 of 1999 about Consumer Protection not only protect the consumer itself, but also protect the business actor who is aggrieved by the consumer and this matter is regulated in Article 6 of the UUPK. |
