| Abstrak (Bhs. Indonesia) | ABSTRAK TINJAUAN YURIDIS TERHADAP KEDUDUKAN SISA TAGIHAN SETELAH DILAKUKAN EKSEKUSI HAK TANGGUNGAN (Studi Terhadap Perkara Nomor 58/Pdt.G/2014/PN.BB). Oleh : THIA MUTIASARI E1A113049 Penelitian ini dilakukan terhadap perkara dan Putusan Pengadilan Nomor 58/Pdt.G/2014/PN. BB, yaitu gugatan wanprestasi dalam perjanjian kredit setelah dilakukan eksekusi objek hak tanggungan. Permasalahan yang diajukan dalam penelitian ini adalah : 1. Bagaimana kedudukan sisa tagihan setelah dilakukan eksekusi objek hak tanggungan dan 2. Bagaimana dasar pertimbangan dan putusan Hakim dalam menyelesaiakan perkara ini. Adapun tujuan penelitiannya adalah : melakukan analisis terhadap kedudukan sisa tagihan setelah dilakukan eksekusi hak tanggungan dan melakuan analisis terhadap dasar pertimbangan dan putusan hakim. Metode penelitian yang digunakan adalah metode yuridis normatif, dengan spesifikasi penelitian diskriptif analitis dan analisis secara kualitatif. Berdasarkan hasil analisis diperoleh hasil bahwa: pertama, Keduduan sisa tagihan setelah dilakukan eksekusi objek hak tanggungan menjadi tagihan konkuren, yang hanya dijamin dengan jaminan umum berdasarkan Pasal 1131 dan 1132 KUH Perdata. Dan kedua, Dasar pertimbangan dan putusan Hakim tidak menyelesaikan persoalan antara Kreditur dan Debitur atas pembayaran sisa tagihan, dan bertentangan dengan asas schuld-haftung sebagaimana diatur dalam Pasal 1131 KUH Perdata. | Abtrak (Bhs. Inggris) | ABSTRACT JURIDICAL REVIEW OF BILLING REMEDY POSITION AFTER THE EXECUTION OF RESPONSIBILITY RIGHTS (Study of Case Number 58 / Pdt.G / 2014 / PN.BB). By: THIA MUTIASARI E1A113049 This research was conducted on cases and court decisions number 58 / Pdt.G / 2014 / PN. BB, namely the default claim in the credit agreement after the execution of the mortgage rights object. The problems raised in this study are: 1. How is the position of the remaining bills after the execution of the object of liability rights and 2. How is the basis of consideration and decision of the Judge in resolving this case. The research objectives are: to analyze the position of the remaining bills after the execution of mortgage rights and conduct an analysis of the basis of judgments and judgments. The research method used is normative juridical method, with descriptive analytical research specifications and qualitative analysis. Based on the results of the analysis, the results are as follows: first, the maturity of the remaining bills after the execution of the object of the mortgage has become a concurrent bill, which is only guaranteed by a general guarantee based on Article 1131 and 1132 of the Civil Code. And second, the basis of consideration and the decision of the Judge did not resolve the issue between the Creditors and Debtors for the payment of the remaining bills, and contrary to the principle of schuld-haftung as stipulated in Article 1131 of the Civil Code.
