Indonesia) | ABSTRAK SAFE HOUSE (PERLINDUNGAN HUKUM TERHADAP SAKSI TINDAK PIDANA KORUPSI DI KOMISI PEMBERANTASAN KORUPSI) Oleh: PUTRI AYU SORAYA E1A013037 Pengungkapan suatu tindak pidana korupsi sangat membutuhkan peranan saksi, namun demikian perlindungan hukum terhadap saksi tindak pidana korupsi masih sangat sulit dilakukan. Saksi dalam kasus tindak pidana korupsi dalam hal ini sangat membutuhkan perlindungan hukum yang salah satu bentukya yaitu safe house. Berdasarkan hal tersebut maka permasalahan yang akan dikaji adalah mengenai bentuk-bentuk perlindungan dalam safe house dan faktor-faktor peghambat pemberian perlindungan dalam safe house. Metode penelitian dengan menggunakan pendekatan yuridis sosiologis dan spesifikasi penelitian adalah deskriptif. Lokasi penelitian di Komisi Pemberantasan Korupsi Jakarta. Jenis dan sumber data adalah data primer dan data sekunder. Metode pengumpulan data primer dengan wawancara, sedangkan data sekunder dengan studi pustaka. Metode pengolahan data dengan reduksi data, display data, dan kategorisasi data. Penyajian data secara sistematis. Metode analisis data yakni kualitatif dalam bentuk content analysis method dan constant comparative analysis method. Hasil penelitian menunjukkan terdapat dua bentuk perlindungan hukum dalam Safe House terhadap saksi tindak pidana korupsi yang diberikan oleh KPK, yaitu perlindungan fisik dan perlindungan non-fisik. Namun demikian, dalam pelaksanaanya terdapat beberapa faktor penghambat, baik faktor internal maupun faktor eksternal yang berkaitan dengan aspek faktor hukumnya, penegakkan hukum, sarana dan prasarana, masyarakat, budaya hukum masyarakat, dan personal saksi dalam upaya perlindungan hukum terhadap saksi tindak pidana korupsi. Inggris) | ABSTRACT SAFE HOUSE (LEGAL PROTECTION ON WITNESS OF CORRUPTION MEASURES IN CORRUPTION ERADICATION COMMISSION) By: PUTRI AYU SORAYA E1A013037 Disclosure of a criminal act of corruption highly requires the role of witnesses, however, legal protection against witnesses of corruption is greatly delicate process. Witness in the case of corruption is in need of legal protection and one of the form of protection is Safe House. Based on this matter, the exploration should be pointed to the forms of protection in the safe house and the factors constraining the protection in the safe house. The research method using sociological judiciary approach and research specification should be illustrative. Location of research is at the Corruption Eradication Commission Jakarta. The types and sources of data are primary and secondary data. Method of collecting primary data is by interview, while secondary data with literature study. Data processing methods with data reduction, data display, and data categorization. Systematic data presentation. The method of data analysis is qualitative in the form of content analysis method and constant comparative analysis method. The result of the research shows that there are two forms of legal protection in Safe House against the witness of corruption crime given by ECE, namely physical protection and non-physical protection. However, in the implementation there are several restraining factors, both internal factors and external factors related to aspects of legal factors, law enforcement, facilities and infrastructure, community, culture of public law, and personal witness in the effort to protect the law toward witnesses of corruption.
