Indonesia) | ABSTRAK PERLINDUNGAN HUKUM DALAM PROSES PENYIDIKAN TERHADAP TINDAK PIDANA ANAK DI POLRES WONOSOBO Oleh : AJENG SANTIKA LARASATI E1A013101 Pengaturan Hukum terhadap anak yang melakukan tindak pidana merupakan salah satu bentuk penghormatan terhadap hak asasi manusia, termasuk penghormatan pada hak anak yang berkonflik dengan hukum, mengenai pengaturan pemberian bantuan hukum ini diatur dalam beberapa peraturan perundang-undangan seperti Undang-Undang Nomor 8 Tahun 1981 tentang KUHAP dan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Berdasarkan hal tersebut timbul pertanyaan bagaimana upaya perlindungan hukum dalam proses penyidikan terhadap tindak pidana anak di Polres Wonosobo. Penelitian ini dilakukan dengan metode pendekatan yuridis sosiologis. Pendekatan tersebut digunakan untuk mengkaji permasalahan dari segi hukum dan sistematikanya serta digunakan untuk mengkaji suatu masalah di dalam masyarakat atau lingkungan masyarakat Tujuan penelitian ini untuk mengetahui bagaimana perlindungan hukum dalam proses penyidikan terhadap tindak pidana anak di Polres Wonosobo dan apakah perlindungan tersebut telah sesuai dengan ketentuan – ketentuan yang tercantum dalam Undang-Undang sistem peradilan pidana anak. Polres Wonosobo dalam melakukan penyidikan terhadap semua anak yang berhadapan dengan hukum memberikan pendampingan bantuan hukum dari Pelayanan Terpadu Perlindungan Perempuan dan Anak dan UPIPA. Perlindungan hukum dalam pendampingan bantuan hukum diberikan sebelum dilakukannya penyidikan, dengan adanya surat pemberitahuan penyidikan dari Penyidik Anak di Polres Wonosobo kepada UPIPA ataupun Pelayanan Terpadu Perlindungan Perempuan dan Anak Kabupaten Wonosobo. Dan dalam pelaksanaannya yang diberikan di Polres Wonosobo sudah sesuai dengan ketentuan yang diatur dalam Sistem Peradilan Pidana Anak. Kata Kunci: Perlindungan hukum, Tingkat Penyidikan, Anak. |

Based on the fact above, the question arises on how the legal protection efforts in the process of investigation of child crime in Polres Wonosobo. This approach is used to examine problems in terms of law and systematics and is used to examine a problem in society or community environment The purpose of this study is to find out how the legal protection in the investigation process of child crime in Polres Wonosobo and whether the protection is in accordance with the provisions contained in the Law of the criminal justice system of children. Polres Wonosobo in conducting an investigation of all children facing the law provides legal assistance from the Integrated Services for the Protection of Women and Children and UPIPA. Legal protection in legal assistances are provided prior to the investigation, with an investigation notice from Child Investigator at Polres Wonosobo to UPIPA or Integrated Service of Wonosobo Women and Children Protection. And in the implementation given in Polres Wonosobo has been accordance with the provisions set out in the Criminal Justice System of Children.
