| Abstrak (Bhs. Indonesia) | Perkembangan tindak pidana korupsi di Indonesia masih tergolong tinggi, sehingga dapat dikatakan bahwa korupsi sebagai virus yang dengan mudahnya menyebar ke seluruh tubuh pemerintahan. Perkembangan korupsi yang demikian mempunyai relevansi dengan kekuasaan karena dengan kekuasaan itu penguasa dapat menyalahgunakan kekuasaannya untuk kepentingan pribadi. Salah satu persoalan upaya pemberantasan tindak pidana korupsi adalah masalah penegakan hukum, khususnya proses peradilan. Untuk dapat mengungkap pelaku tindak pidana korupsi yang terorganisir, guna menyeret pelaku utama dan tersangka lainnya tentunya membutuhkan pembuktian yang signifikan. Dalam hal pembuktian dibutuhkan saksi yang sekaligus menjadi pelaku tindak pidana korupsi dan mau bekerjasama dengan penegak hukum untuk mengungkap tindak pidana korupsi, yang disebut justice collaborator. Penelitian ini pada intinya untuk mengetahui peran terdakwa sebagai justice collaborator dan implikasi justice collaborator dalam mengungkap kasus tindak pidana korupsi khusunya dalam putusan nomor: 32/Pid.Sus/TPK/2016/PN.Jkt.Pst. Penelitian ini menggunakan metode pendekatan yuridis normatif yaitu dengan cara menelaah sumber data sekunder berupa bahan hukum primer, sekunder dan tersier. Metode penelitian yang digunakan dalam penelitian ini adalah normatif kualitatif yaitu mengolah dan menafsirkan berdasarkan pada putusan maupun perundang-undangan yang berkaitan dengan penelitian. Dalam penelitian putusan nomor: 32/Pid.Sus/TPK/2016/PN.Jkt.Pst., peran terdakwa secara signifikan berhasil mengungkap kejahatan tindak pidana korupsi yang terorganisir, namun status justice collaborator terdakwa tidak berdampak pada implikasi terhadap hak terdakwa sebagai justice collaborator yaitu berupa pengurangan hukuman. |

| Abtrak (Bhs. Inggris) | In Indonesia corruption is getting developed day by day, so it can be said that corruption as a virus that easily spread to the entire body of government. Corruption development has relevance to the power of authority because with that power the ruler can abuse his power for personal income. One of the problem to eradicate corruption is the problem of law enforcement, especially the judicial process. To be able to reveal the perpetrators of organized criminal acts of corruption, and to drag the main perpetrators and other suspects would require significant proof. In collecting tne proof, it is required witnesses who at the same time become perpetrators of criminal acts of corruption and willing to cooperate with law enforcement to reveal corruption, called justice collaborator. This research is basically to know the role of defendant as justice collaborator and the implication of justice collaborator in uncovering corruption crime case especially in decision number: 32 / Pid.Sus / TPK / 2016 / PN.Jkt.Pst. This study used normative juridical approach method by examining secondary data sources in the form of primary, secondary and tertiary legal materials. The research method used in this research is normative qualitative, that are processing and interpreting based on decision and legislation related to research. In the research of verdict number 32/Pid.Sus/TPK/2016/PN.Jkt.Pst., The defendant's role was significantly successful in uncovering the crime of organized corruption crime, but the defendant's justice collaborator status has no impact on the implication of defendant's right as justice collaborator ie a reduction in punishment. |
