| Abstrak (Bhs. Indonesia) | Upaya penegakan hukum merupakan suatu tindakan yang harus dilakukan oleh aparat penegak hukum untuk mengungkap suatu tindak pidana maupun kejahatan yang dilakukan oleh seseorang. Penegakkan hukum dalam proses penangkapan tersangka dilakukan oleh anggota Kepolisian yang mempunyai wewenang dalam melakukan proses tersebut. Namun seringkali dalam menengakkan hukum terutama pada proses penangkapan, anggota Kepolisian yang ada di lapangan menemui beberapa kendala yang dapat menghambat proses penangkapan tersebut. Sehingga dalam upaya proses penangkapan tidak jarang pula anggota Kepolisian menggunakan kekuatan dalam upaya tersebut, dalam hal ini melakukan tindakan tembak di tempat bagi tersangka yang berupaya melawan petugas maupun menghalangi upaya petugas untuk melakukan proses penangkapan dan tersangka yang dapat membahayakan nyawa petugas maupun warga masyarakat. Berdasarkan latar belakang tersebut penulis mencoba mengemukakan permasalahan mengenai alasan penyidik melakukan tindakan tembak di tempat dalam proses penangkapan dan prosedur penangkapan oleh penyidik dengan disertai tindakan tembak di tempat. Artikel ilmiah ini merupakan penelitian yuridis sosiologis dimana yuridis adalah hal yang berkaitan dengan norma atau aturan yang mengatur, dan sosiologis adalah untuk mengetahui sejauh mana hukum dapat diterapkan dalam kehidupan di masyarakat. Berkaitan dengan hal tersebut peraturan yang mengatur mengenai tindakan tembak di tempat oleh anggota Kepolisian diatur dalam Peraturan Kapolri Nomor 8 Tahun 2009 Tentang Implementasi Implementasi Prinsip dan Standar HAM Dalam Penyelenggaraan Tugas Kepolisian Negara RI, kemudian Perkapolri Nomor 1 Tahun 2009 Tentang Penggunaan Kekuatan Dalam Tindakan Kepolisian, serta dalam hal penangkapan didasarkan pada Undang-Undang Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana. |

| Abtrak (Bhs. Inggris) | Law enforcement efforts is an act that should be done by law enforcement agencies to uncover a crime or crimes committed by someone. Enforcement of the law in the process of catching the suspect conducted by members of the police force which has the authority to conduct the process. But often in the law enforcement especially in the process of catching up, members of the police force that exists in the field met several obstacles that could hinder the process of catching up. So in an attempt to process the arrest of members of the police force also frequently uses the power in these efforts, in this case doing a shoot in a place for a suspect that had tried to fight off officers nor hinder officers attempt to in the process of arrest and suspects that may harm the lives of officers as well as the citizens of the community. Based on the background of the author tried to put forward problems concerning the reasons investigators doing a shoot in a place in the process of arrest and arrest procedures by investigator with action shoot on the spot. Scientific articles this is the juridical sociological research which is juridical matters related to the norms or rules that govern, and sociological is to know the extent to which the law can be applied in the life of society.
