Penelitian ini bersumber pada putusan Mahkamah Agung Nomor 843 K/Pdt.Sus-PHI/2016 yang memperbaiki putusan Pengadilan Hubungan Industrial Nomor 32/Pdt.Sus-PHI/2015/Pn.Mdn mengenai perkara PHK karena pekerja di mutasi PT. Olgafood Industri Tanjung Morawa dan Mahkamah Agung memberi putusan yang berbeda dengan ketentuan Undang- Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan yakni memberikan uang pesangon sebesar 2 kali ketentuan Pasal 156 ayat (2)
Penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan penelitian menggunakan pendekatan undang-undang dan konseptual. Spesifikasi penelitian yang digunakan deskriptf analitis. Sumber bahan hukum yang digunakan bahan hukum primer dan bahan hukum sekunder. Metode analisis data menggunakan interpretasi gramatikal dan sistematis.
Berdasarkan hasil penelitian dan pembahasan bahwa mekanisme PHK yang dilakukan PT. Olgafood Industri tidak sesuai dengan ketentuan yang berlaku karena tidak memenuhi unsur ketentuan Pasal 106 ayat (1) dan (2) Undang-Undang Nomor 13 Tahun 2003 tentang ketenagakerjaan dan Pasal 3 ayat (1) Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, menurut peraturan perundang-undangan apabila perusahaan tetap melakukan PHK sesuai Pasal 155 ayat (1) PHK tersebut batal demi hukum. Putusan Mahkamah Agung Nomor 843K/Pdt.Sus-PHI/2016 sudah tepat dikategorikan PHK karena melanggar perjanjian kerja karena memenuhi unsur Pasal 161 Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan tetapi kurang tepat dalam pertimbangan hukum karena PHK karena penolakan mutasi dikategorikan mengundurkan diri seperti Pasal 162 ayat (1) karena tidak memenuhi unsur unsur pasal tersebut.

This study comes from Supreme Court Decision No. 843 K / Pdt.Sus-PHI / 2016 which corrected the decision of Industrial Relations Court Number 32 / Pdt.Sus-PHI / 2015 / Pn.Mdn regarding the case of layoffs because workers in mutation PT. Olgafood Industri Tanjung Morawa and the Supreme Court gave a different decision with the provisions of Law Number 13 Year 2003 on Manpower namely giving severance pay twice by the provisions of Article 156 paragraph (2) This research uses normative juridical research method. The research approach uses a legal and conceptual approach.
Research specification used analytical descriptive. Sources of legal materials used primary legal materials and secondary legal materials. Methods of data analysis using grammatical and systematic interpretation.
Based on the results of research and discussion that the mechanism of layoffs made PT. Olgafood Industri does not comply with the applicable provisions because it does not comply with the provisions of Article 106 paragraph (1) and (2) of Law Number 13 Year 2003 concerning manpower and Article 3 paragraph (1) of Law Number 2 Year 2004 concerning Settlement of Dispute Relations Industrial, according to the regulation if the company keeps laid off in accordance with Article 155 paragraph (1) The layoffs are null and void. The Supreme Court Decision Number 843K / Pdt.Sus-PHI / 2016 has been appropriately categorized as layoff because it violates the work agreement because it fulfills the element of Article 161 of Law Number 13 Year 2003 concerning Manpower but is not appropriate in the legal consideration because of the dismissal because mutation refusal is categorized as resigning Article 162 paragraph (1) because it does not meet the elements of the article.
