| Abstrak (Bhs. Indonesia) | Negara Indonesia adalah negara hukum, berdasarkan Pancasila sebagai dasar negara. Salah satu nilai yang terkandung dalam Pancasila adalah agama, pada sila pertama. Selain itu, nilai agama diatur juga dalam UUD 1945 pada Pasal 28E, 28I dan 29. Secara implisit pasal tersebut menyiratkan bahwa beragama adalah hak konstititusional, dan pemerintah wajib membuat kebijakan yang berkaitan dengan agama. Namun saat ini, pemerintah belum optimal membuat kebijakan di bidang agama, sehingga masih timbul permasalahan agama yang belum terselesaikan. Jemaat Ahmadiyah Indonesia merupakan salah satu Ormas Islam berbadan hukum, dan telah memiliki dokumen hukum yang sah. Namun terdapat tindakan pemerintah yang ditujukan kepada Jemaat Ahmadiyah Indonesia dan keputusan MUI yang menyatakan bahwa organisasi tersebut sesat, sehingga menimbulkan permasalahan dalam kehidupan beragama. Penelitian berjudul “PARADIGMA HUKUM NASIONAL TERHADAP ALIRAN AGAMA DALAM KONSEP NEGARA HUKUM INDONESIA (Suatu Kajian Yuridis Tentang Legalitas Jemaat Ahmadiyah Indonesia)” merupakan penelitian yuridis normatif. Penelitian ini menghasilkan dua kesimpulan, kesimpulan pertama bahwa terdapat beberapa norma hukum yang mengatur urusan agama baik norma hukum nasional dan internasional yang telah diratifikasi dalam berbagai bentuk norma hukum, namun tidak ada norma hukum yang berbentuk peraturan yakni undang-undang. Kesimpulan kedua bahwa kedudukan Jemaat Ahmadiyah Indonesia dinyatakan sah secara hukum, namun terdapat beberapa norma hukum yang secara substansi ditujukan langsung kepada Jemaat Ahmadiyah Indonesia, tetapi tidak menimbulkan akibat hukum terhadap kedudukan hukum Jemaat Ahmadiyah Indonesia walaupun dianggap menimbulkan kerugian hak konstitusional penganut Jemaat Ahmadiyah Indonesia. |
| Abtrak (Bhs. Inggris) | The state of Indonesia is a state of law, based on Pancasila as the basis of the state. One of the values contained in Pancasila is religion, in the first sila. other than that, religious values are also regulated in the 1945 Constitution on Article 28E, 28I and 29. Implicitly the article implies that religion is a constitutional right, and the government is obliged to make policies relating to religion. But this time, the government has not been optimal in making policy in the field of religion, so there are still unresolved religious issues. The Ahmadiyya Community of Indonesia is one of the Islamic Communities, and has had a valid legal document. However there are government actions addressed to the Ahmadiyya Community of Indonesia and MUI decisions stating that the organization is heretical, which cause many problems in religious life. Research entitled “PARADIGM OF NATIONAL LAW ON RELIGIOUS IN THE LEGAL CONCEPTS INDONESIA (A Juridical Study on the Legality of The Ahmadiyya Community of Indonesia)” is a normative juridical study. This research resulted in two conclusions, the first conclusion that there are several legal norms governing religious affairs both national and international legal norms that have been ratified in various forms of legal norm, but there is no legal norm in the form of legislation that is the law. The second conclusion that the position of the Ahmadiyya Community of Indonesia is declared legally valid, but there are several legal norms that are substantially addressed directly to the Ahmadiyya Community of Indonesia, but has no legal effect on the legal standing of the Ahmadiyya Jama'at although it is deemed to cause a loss of constitutional rights of adherents the Ahmadiyya Community of Indonesia. |
