| Abstrak (Bhs. Indonesia) | Keabsahan Keputusan Tata Usaha Negara harus sesuai dengan perundang-undangan dan Asas-Asas Umum Pemerintahan yang Baik karena akan berakibat pada dinyatakan batal atau tidak sahnya KTUN. Salah satu kasus mengenai pembatalan KTUN, terdapat dalam Putusan PTUN Jakarta Nomor 242/G/2015/PTUN-JKT. Dalam hal ini Penulis tertarik meneliti mengenai keabsahan Surat Keputusan objek sengketa dari aspek prosedural dan substansial serta mengenai akibat hukum atas dibatalkanna Surat Keputusan objek sengketa terhadap Pemberhentian dengna hormat sebagai Pejabat Administrator. Dalam rangka menjawab permasalahan di atas, metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan kasus, pendekatan perundang-undangan dan pendekatan konseptual. Data yang digunakan adalah data primer berupa putusan pengadilan dan data sekunder yang berupa Peraturan Perundang-undangan dan buku-buku literatur. Dalam hasil penelitian diketahui bahwa, Surat Keputusan objek sengketa yang dikeluarkan oleh Menteri Pendidikan dan Kebudayaan bertentangan dengan peraturan perundang-undangan ditinjau dari Apek Prosedural sebagaimana diatur dalam Peraturan Pemerintah Nomor 100 Tahun 2000 tentang Pengangkatan Pegawai Negeri Sipil Dalam Jabatan Struktural dan dari Aspek Substansial sebagaimana diatur dalam Peraturan Menteri Pendidikan dan Kebudayaan Nomor 11 Tahun 2015 tentang Organisasi dan Tata Kerja Kementerian Pendidikan dan Kebudayaan. Majelis Hakim menyatakan bahwa Surat Keputusan objek sengketa batal, sehingga gugatan Penggugat dinyatakan dikabulkan. Pertimbangan hukum Majelis Hakim tersebut sudah sesuai dengan peraturan perundang-undangan dan doktrin. Akibat hukum dikabulkannya gugatan Penggugat yakni Surat Keputusan objek sengketa batal dan tergugat berkewajiban mencabut Surat Keputusan objek sengketa. |

Inggris) | The validity of the State Administrative Decision shall be in accordance with the laws and the Good Governance Principles as it results in declared null and void of the State Administrative Decision. One of the cases concerning the cancellation of State Administrative Decision is found in the Decision of The State Administrative Court of Jakarta Number 242 / G / 2015 / PTUN-JKT. In this case the author is interested in examining the decree of the object of dispute’s validity from the procedural and substantial aspects as well as on the legal consequences of the undeclared decree of the object of dispute against Dismissal with respect as Administrator Official. In order to answer the above problem, research method used is legal research with case approach, approach of legislation and conceptual approach. The data used are primary data in the form of court decision and secondary data in the form of legislation and literature books. In the result of the research, it is known that the decree of the object of dispute issued by the Minister of Education and Culture is contradictory to the legislation in accordance with Government Regulation Number 100 of 2000 concerning the Appointment of Civil Servant in Structural Position and and from the aspect of substantial as regulated in the Regulation of the Minister of Education and Culture No. 11 of 2015 on the Organization and Working Procedures of the Ministry of Education and Culture. The Panel of Judges stated that the decree of the object of dispute is void, so that statement of claim is granted. The legal considerations of the Panel of Judges are in accordance with the laws and doctrines. As a result of the law granted the statement of claim that the Decree of the object of the dispute is void and the defendant is obliged to revoke the decree of the object of dispute. |
