Indonesia) | ABSTRAK PROSTITUSI ONLINE MELALUI MEDIA FACEBOOK DITINJAU DARI UNDANG-UNDANG NOMOR 11 TAHUN 2008 TENTANG INFORMASI DAN TRANSAKSI ELEKTRONIK (ITE) (Studi Putusan Pengadilan Negeri Sleman Nomor.470/Pid.Sus/2014/PN.Smn) Lahirnya internet mengubah paradigma baru dalam kehidupan manusia. Kehidupan manusia berkembang menjadi serba online dan global, kehidupan berubah dari yang bersifat nyata (real) ke realitas baru yang bersifat maya (virtual). Internet yang telah menjadi gaya hidup masyarakat saat ini justru menghadirkan kompleksitas pemahaman salah satunya adalah masalah prostitusi yang dilakukan secara online, salah satunya dengan menggunakan media facebook.. Prostitusi online ini dapat dijerat dengan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi Dan Transaksi Elektronik, namun dalam undang-undang tersebut juga tidak disebutkan secara khusus ketentuan mengenai prostitusi online. Berdasarkan atas hasil penelitian, dakwaan pertama Jasa Penuntut Umum dalam Pasal 45 ayat (1) Jo Pasal 27 ayat (1) Undang-Undang Nomor 11 Tahun 2008 tentang Informasi Dan Transaksi Elektronik sudah didasarkan pada fakta-fakta hukum dalam persidangan dan telah terpenuhi semua unsur-unsurnya. Hakim Pengadilan Negeri Sleman yang memeriksa, mengadili dan memutus perkara dalam Putusan Nomor. 470/Pid.Sus/2014/PN.Smn, sebelum menjatuhkan putusan pidana terhadap Terdakwa MMP maka hakim perlu mempertimbangkan beberapa hal baik pertimbangan hukum (yuridis) maupun pertimbangan non hukum ( non yuridis). Berdasarkan hal tersebut maka Majelis Hakim menyatakan Terdakwa MMP terbukti secara sah dan meyakinkan melakukan tindak pidana Mendistribusikan atau Mentransmisikan atau Membuat dapat Diaksesnya Informasi Elektronik yang Memiliki Muatan Melanggar Kesusilaan. Inggris) | ABSTRACT Prostitution Online Through The Medium Of Facebook In Terms Of Law No. 11 Of 2008 On Information and Electronic Transactions (ITE) (Studies Of The Country Sleman No. 470/Pid.Sus/2014/PN.Smn) The born of the internet changed the new paradigm in human life. Human life has developed into completely online and global, life turned form the real to new reality that is virtual. Internet has become a lifestyle of today’s society it presents the understanding one of them is the problem of prostitution is done online, one of them with the use of media in facebook. Prostitution online can be entangled with the Law No.11 Of 2008 On Information and Electronic Transaction, but in the law is also not mentioned specifically the provisions on prostitution online. Based on the results of research, the public prosecutor’s indictment in article 45 paragraph 1 Jo Article 27 paragraph 1 of Law No.11 Of 2008 On Information and Elektronic Transaction is based on the facts of law in the trial and has fulfilled all its elements. The jugde said the district court sleman check, prosecute and deciding the case in the decision of No.470/Pid.Sus/2014/PN.Smn, before dropping the criminal verdict against the defendant MMP the judges need to consider some good things the legal considerations juridical and consideration for the law. Based on that then the judges said the defendant MMP been proven legally and convincingly performs criminal acts of distributing or transmitting or making can in access to its electronic information that has cargo in violation of decency.
